An Act to provide for the Maintenance and Management of the Otago Museum, and for the Endowment of the Dunedin Athenaeum.

  • Preamble

    WHEREAS the Superintendent and Provincial Council of the Province of Otago constructed and maintained a Museum at Dunedin, in the Province of Otago: And whereas there is in Dunedin an Athenaeum and Mechanics' Institute, incorporated by an Ordinance of the Superintendent and Provincial Council of Otago, No 329, intituled The Dunedin Athenaeum and Mechanics' Institute Ordinance 1870: And whereas it is desirable to provide for the maintenance of the said Museum at Dunedin: And whereas it is desirable to vest a portion of the reserve on which the present Museum is erected, and the said Museum and all the property connected therewith, in the Otago University, incorporated by an Ordinance of the Superintendent and Provincial Council of Otago, intituled The University of Otago Ordinance 1869, to be maintained and managed by the said Otago University: And whereas it is desirable to provide an endowment for the said Dunedin Athenaeum and Mechanics' Institute:

BE IT THEREFORE ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title

  • The Short Title of this Act shall be The Otago Museum Act 1877.

2 Property vested in University

  • The land described in Schedule 1 to this Act, and all the buildings thereon, and all the exhibits in and other property connected with the Otago Museum, shall be and the same are hereby absolutely vested in and transferred to the Otago University, incorporated by the said University of Otago Ordinance 1869, and shall be held by the said Otago University in trust for a Museum.

3 Pastoral lands vested in University

Schedule 1

ALL that parcel of land on which the present Museum is erected and the grounds adjoining thereto, being all that area in the Colony of New Zealand containing by admeasurement one (1) acre, more or less, being Sections numbered respectively twenty-five (25), twenty-six (26), twenty-seven (27), and twenty-eight (28), Block twenty-nine (XXIX), on the map of the City of Dunedin. Bounded towards the North by Section twenty-nine (29), two hundred and fifty (250) links; towards the East by Sections thirty-three (33), thirty-four (34), thirty-five (35), and thirty-six (36), four hundred (400) links; towards the South by Section twenty (20), two hundred and fifty (250) links; and towards the West by Great King Street, four hundred (400) links.

Schedule 2

All that area in the Provincial District of Otago, containing by admeasurement eleven thousand (11,000) acres, more or less, being parts of Runs numbered twenty (20) and seventy-seven (77) on the map of the North-eastern Pastoral District, deposited in the Survey Office, Dunedin. Bounded towards the North by an east and west line from a point on the Taieri River due east of Trigonometrical Station D, Nenthorn Survey District, to its intersection with a line from Hummock Trigonometrical Station to Silver Peak Trigonometrical Station; towards the East by a portion of the said line connecting Hummock Trigonometrical Station and Silver Peak Trigonometrical Station to a point due east of Trigonometrical Station C, Silver Peak District; towards the South by an east and west line through said Trigonometrical Station to boundary of Run No twenty (20) at Allen Stream, thence by that stream to the Taieri River; and towards the South-west and West by the Taieri River. Excepting therefrom all pre-emptive rights, and also the right to take railway and road lines without compensation.
