West Harbour Borough Empowering Act 1884

An Act to authorize the Raising of a Loan by the Borough Council of West Harbour in discharge of a Debt due to the Waikouaiti County.

1 Short Title
  • The Short Title of this Act is The West Harbour Borough Empowering Act 1884.

2 West Harbour Borough may borrow $2,101.75c to pay debt to Waikouaiti County
  • The Borough Council of the Borough of West Harbour is hereby empowered to raise, by special loan, under the provisions of section 148 of The Municipal Corporations Act 1876, a sum not exceeding in amount a total sum of two thousand one hundred and one dollars and seventy-five cents, to be applied by the Council aforesaid towards discharging the debt due by the Borough to the County of Waikouaiti at the time of its severance therefrom, and the accrued interest thereon, and to no other purpose whatsoever.

    The words two thousand one hundred and one dollars and seventy-five cents were substituted, as from 10 July 1967, for the words one thousand and fifty pounds seventeen shillings and sixpence pursuant to section 7(1) Decimal Currency Act 1964 (1964 No 27).

3 Loan to be a special loan under Municipal Corporations Act 1876
  • The loan to be raised for the purpose aforesaid under this Act shall be deemed to be a special loan within the meaning of The Municipal Corporations Act 1876, all provisions whereof, so far as applicable, shall apply in respect to such loan; and the raising of such loan shall be good and valid, notwithstanding it should hereafter appear that the Borough Council of West Harbour has at any time heretofore exercised the powers of the 148th section aforesaid for the same purpose.
