Wellington Asylum, Home, Hospital, and Orphanage Reserves Act 1888

An Act to define the Reserves of the Wellington Hospital, Lunatic Asylum, Home for the Aged, and Orphanage.

  • Preamble

    WHEREAS the lands described in the Schedules hereto were held by the Superintendent of the Province of Wellington, and now, by virtue of The Abolition of Provinces Act 1875, have become vested in Her Majesty the Queen:

    And whereas the said lands have long since been appropriated to the respective purposes hereinafter mentioned, but by reason of their boundaries not having hitherto been specifically defined, they have not been absolutely vested in the institutions for which they were intended:

    And whereas it is expedient to make an apportionment of the said lands in manner hereinafter mentioned:

BE IT THEREFORE ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title
  • The Short Title of this Act is The Wellington Asylum, Home, Hospital, and Orphanage Reserves Act 1888.

2 Apportionment of asylum lands
  • The lands described in Schedule 1, and all buildings and erections thereon, are hereby vested in Her Majesty the Queen for the purposes of a lunatic asylum.

3 Lands of home for aged poor
  • The lands described in Schedule 2, and all buildings and erections thereon, are hereby vested, for the purposes of a home for the aged poor, in the Wellington Society for Relief of the Aged Needy, incorporated under The Hospitals and Charitable Institutions Act 1885, who shall hold the said lands for the purposes aforesaid, subject to the Act last named.

4 Wellington Hospital lands
  • The lands described in Schedule 3, and all buildings and erections thereon, and the lands described in Schedule 4, together with all proceeds therefrom, are hereby vested in the Wellington Hospital Contributors, incorporated as a separate institution under The Hospitals and Charitable Institutions Act 1885, for the purposes of a general hospital at Wellington, subject to the said Act; and subject also that it shall not be lawful to apply the rents or annual profits of the lands or any part of the lands described in Schedule 4, to the maintenance of a denominational hospital.

5 Reserve for orphanage
  • The lands described in Schedule 5 are hereby vested, for the purposes of an orphanage, in the Wellington Benevolent Institution Contributors, incorporated under The Hospitals and Charitable Institutions Act 1885, who shall hold the said lands for the purposes aforesaid, subject to the Act last named, and subject also that it shall not be lawful to apply the rents or annual profits of the said lands, or any part thereof, to the maintenance of a denominational orphanage.

6 Trustees may mortgage rents of lands, but not the lands
  • Nothing contained in The Hospitals and Charitable Institutions Act 1885, shall authorise the trustees, or others in whom may become vested the lands herein referred to, to borrow money upon the security of the freehold of such lands, but only upon mortgage of the rents and profits thereof, for a period not longer than forty-two years.

7 Repeal
  • The Wellington City Reserves Act 1872 Amendment Act 1877, is hereby repealed.


Schedule 1
Wellington lunatic asylum land

All that piece or parcel of land in the City of Wellington, containing 61 acres 1 rood 2 perches, more or less, being part of the land mentioned in Schedule 1 of The Wellington City Reserves Act 1872. Bounded towards the north by the Wellington College land, 393, 222, 220, 234, 225, 1313, and 1030 links; towards the south-east by part of the said Town Belt, 1356 and 204 links; towards the south by the termination of Coromandel Street and of part of Owen Street, and by Sections Nos 774, 773, 772, and 771, 398, 126, and 806 links respectively; towards the south-west by lines, 105, 130, 672, and 469 links respectively, and by a road, 660 and 710 links respectively; towards the west by Sections Nos 758, 757, 756, 747, and 746, and the termination of Drummond Street and of another street, 1512 links: be all the said linkages more or less; as the said area is delineated upon the plans in the District Survey Office, Wellington.

Schedule 2
Wellington Aged Home land

ALL that piece or parcel of land in the City of Wellington, containing 4 acres, more or less, being part of the land mentioned in Schedule 1 of The Wellington City Reserves Act 1872. Bounded towards the north-east by the Wellington Lunatic Asylum land, 410, 130, and 105 links; towards the south-east by part of Owen Street, 65 links; again towards the north-east by Owen Street, 260 links; again towards the south-east by Section No 770, 465 links; towards the south-west by a line bearing N 12° 40′ W, 871 links; and towards the north-west by a line bearing north 77° 20′ east, 358 links: be all the aforesaid linkages more or less; as the same is delineated upon the plans in the District Survey Office, Wellington.

Schedule 3
Wellington Hospital land

ALL that piece or parcel of land in the City of Wellington, containing 13 acres, more or less, being part of the land mentioned in Schedule 1 of The Wellington City Reserves Act 1872. Bounded towards the north-east by a public road, 713 and 680 links, and by lines, 469 and 261 links respectively; towards the south and east by the Aged Home land, 358 and 871 links respectively; again towards the south by Section No 770 and the termination of Daniel Street, 385 links, and Section No 769, 595 links; and towards the west by Sections Nos 766, 765, 764, 763, 762, 761, 760, 759, and a reserve, 1655 links: be all the said linkages more or less; excepting from the above-circumscribed area a road 60 links wide into the aged home land; as the same is delineated upon the plans in the District Survey Office, Wellington.

Schedule 4
Wellington Hospital reserves

ALL that parcel of land in the City of Wellington, containing by admeasurement 1 acre 3 roods 29 perches more or less. Bounded towards the north-east by Wesley Road 262 ½ links; towards the south-east by the Wesleyan grant, 1199 links; towards the south-west by the Orphanage Reserve, 227 ½ links; and towards the west generally by a road 50 links wide, 149.7 links.

ALL that parcel of land in the City of Wellington, containing by admeasurement 6 acres 3 roods 18 perches, more or less. Bounded towards the north by the Orphanage Reserve, 345 links; towards the east by a stream, 1565 links; towards the south and south-west by Section No 28, Karori District, 190 and 432 ½ links; and towards the west generally by a road 50 links wide, 1402 links.

Schedule 5
Wellington Orphanage reserve

ALL that parcel of land in the City of Wellington, containing by admeasurement 3 acres 1 rood and 8 perches, more or less. Bounded towards the north by a Hospital Reserve, 227 ½ links, and a Wesleyan Reserve, 293 ½ links; towards the east by the Town Belt, 597 links; towards the south by the Town Belt, 149 ½ links, and a Hospital Reserve, 345 links; and towards the west by a road 50 links wide, 659 links.
