Whangarei Drill-shed Act 1892

An Act to vest in Trustees for the Whangarei Country Rifle-club certain Land at Whangarei known as the Whangarei Drill-shed Site.

  • Preamble

    WHEREAS the land mentioned in the Schedule hereto was acquired by the Whangarei Rifle Volunteer Corps out of the funds of the corps for the purpose of erecting a drill-shed thereon: And whereas such drill-shed was erected by the said corps, assisted by a subsidy from the Defence vote of four hundred and fifty dollars: And whereas the land aforesaid was vested in certain trustees by The Whangarei Drill-shed Act 1888, but the said Trustees have not taken any steps to be registered as the owners of such land, or otherwise completed their title thereto, and the title to said land remains as at the date of the passing of the said Act: And whereas the said Whangarei Rifle Corps has been disbanded and the members thereof formed into a rifle-club: And whereas the said corps previous to its disbandment did by vote of the majority of its members present at a meeting held on the twenty-ninth day of October, one thousand eight hundred and ninety, hand over all its property, including its interest in the said land and building, to the said Rifle-club, subject, however, to such liabilities as might subsist thereon: And whereas it has been agreed by and between the Minister of Defence and the Trustees hereinafter mentioned of the said Club that the fee-simple of and in the said lands and premises should be handed over to the Trustees hereinafter named upon repayment of the said subsidy of four hundred and fifty dollars, and as hereinafter provided:

    The expression four hundred and fifty dollars was substituted, as from 10 July 1967, for the expression two hundred and twenty-five pounds sterling pursuant to section 7(1) Decimal Currency Act 1964 (1964 No 27).

BE IT THEREFORE ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title
  • The Short Title of this Act is The Whangarei Drill-shed Act 1892.

2 Repeal

    Section 2 was repealed, as from 19 November 1907, by section 2 Statutes Repeal Act 1907 (1907 No 40).

3 Governor may issue warrant for certificate of title

    Section 3 was repealed, as from 19 November 1907, by section 2 Statutes Repeal Act 1907 (1907 No 40).

    The expression four hundred and fifty dollars was substituted, as from 10 July 1967, for the expression two hundred and twenty-five pounds pursuant to section 7(1) Decimal Currency Act 1964 (1964 No 27).

4 Appointment of new Trustees
  • If at any time hereafter any Trustee of the said Club for the said lands and premises shall die, resign, cease to reside in the Whangarei County, or become incapable to act, a new Trustee shall be appointed in his place by the majority of the members of the Whangarei County Rifle-club present at a meeting called in accordance with the rules of such club for that purpose by advertisement in two consecutive issues of any newspaper circulating in the locality where the head-quarters of the Club for the time being may be, and a minute under the hand of the chairman of such meeting certifying the appointment of such Trustee shall be conclusive evidence of his appointment in accordance herewith.

5 Power to Trustees to mortgage
  • The Trustees of the said Club for the time being for the said lands and premises shall have power to execute a mortgage of the said lands and premises for the purpose of securing the due payment of any moneys advanced for the purpose of acquiring the said lands and premises and of the interest thereon.

6 Power to Trustees to lease
  • The Trustees for the time being shall have power from time to time to let or lease the said land and premises for a term not exceeding twenty-one years at any one time in possession, and upon such terms as they may deem most expedient.

7 Application of moneys
  • All moneys received by the Trustees of the said Club for the rents and profits of the lands vested in them shall, after deducting therefrom all necessary expenses incurred in the management thereof, be applied in and towards the erection and maintenance of any buildings erected upon the said lands, and in and towards the payment of the principal and interest moneys secured by mortgage as aforesaid, and generally in and towards the support of the said Club.

8 Disposal of property on dissolution of Club
  • Upon the dissolution of the said Club the Trustees of the said Club for the time being shall call a meeting of the then members of the said Club by advertisement in two consecutive issues of any newspaper circulating in the locality, and the majority of two-thirds of the members present, representing at least one-half of the members for the time being of the club, at any such meeting shall have power to decide in what manner the said land and premises shall be disposed of, and a certificate under the hand of the person presiding at such meeting stating the resolutions passed thereat shall for all purposes be conclusive proof of such meeting having been duly convened and of all such resolutions having been duly passed thereat, and such property shall, subject to all encumbrances (if any), be realised, sold, converted, or otherwise disposed of as shall be directed in such resolutions.


Schedule

All that piece of land in the Provincial District of Auckland, containing 12.5 perches, more or less, being portions of Lots Nos 15, 16, 18, and 19 of Block No VI of the Town of Whangarei. Commencing at a point distant from the south-western corner of Lot No 19 along Bank Street, 36.3 links; and bounded towards the north-west by Bank Street aforesaid, 60.6 links; towards the north-east by a line at right angles to Bank Street aforesaid, 135.7 links; again towards the north-west by other portion of Lot No 15, 17.4 links; again towards the north-east by Vine Street, 9 links; towards the south-east by Lot No 14 of said Block No 6, 83.6 links; towards the south-west by a line at right angles to Bank Street, 106.5 links: be all the aforesaid linkages more or less.
