An Act to vest the Reserves along the Banks of the Mahinapua Creek and Lake in the Westland Acclimatisation Society.

    The Preamble was repealed, as from 19 November 1907, by section 2 Statutes Repeal Act 1907 (1907 No 40).

BE IT THEREFORE ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title

  • The Short Title of this Act is The Mahinapua Creek and Lake Reserves Act 1893.

2 Certain lands vested in Westland Acclimatisation Society

  • The lands described in the Schedule hereto are hereby vested for an estate of fee-simple in the Westland Acclimatisation Society for the purpose of preserving the fauna and flora thereon.

    Subject to the right of any local authority to make roads or tracks over or through the same, and the right of ingress, egress, and regress through, over, and upon the same to the general public.

3 Protection of fauna

  • It shall not be lawful for any person or persons to disturb or destroy any of the fauna on the said lands, or to discharge any gun or firearm on the said lands without the permission of the Council of the said Acclimatisation Society first obtained; and any person offending against any of the provisions of this section shall be liable to a penalty not exceeding ten dollars, to be recovered in a summary way.

    The reference to “ten dollars” was substituted, as from 10 July 1967, for a reference to “five pounds” pursuant to section 7(1) of the Decimal Currency Act 1964 (1964 No 27).

Schedule

ALL that piece or parcel of land, containing 247 acres, more or less, being the road reserves along and around Mahinapua Creek and Mahinapua Lake, situated in Blocks III, IV, VIII, VII, XI, and XII, Mahinapua Survey District, Land District of Westland. Bounded towards the north by a straight line running south-east from the junction of the Mahinapua Creek with the Hokitika Lagoon to Section No 1484; thence towards the east by Sections Nos 1484, 1482, and 1497, a straight line across Borough Road South, Sections Nos 1038, 1124, Reserve No 52, Sections Nos 1127, 2114, Crown lands, Railway Reserve No 9, Crown lands, Section No 1980, Crown lands, and by a line following the eastern side of Arawata Quay, Mahinapua Township, to Frosty Creek; towards the south by a line across Frosty Creek, and by the south side of Arawata Quay aforesaid, by Crown lands, a straight line across the HP Line Road and by Harbour Board Endowment Reserve No 146; towards the west by said Harbour Board Endowment Reserve, a straight line across Lake Junction Road Reserve, by Crown lands, by a straight line across Pierson Road Reserve, by Crown lands, by Reserve No 271, by Sections Nos 2050, 2049, 2034, Railway Reserve No 9, Sections Nos 1071, 1070, 1069, 1048, 1037, 1035, 1034, 2026, by a straight line across Borough Road South, by Section No 1892, and by Crown lands and Hokitika Lagoon to the commencing-point.
