Waimate Municipal Reserves Act 1895

An Act to authorise the Borough Council of Waimate to acquire certain Parcels of Land.

  • Preamble

    WHEREAS the parcels of land enumerated in the Schedule hereto have, in error, been for many years regarded as part of the municipal endowment of the Borough of Waimate, and have been leased by the Council of the said borough to a public association, which has carried out various improvements thereon: And whereas it is expedient to enable the said Council to acquire the freehold of such parcels of land:

BE IT THEREFORE ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title

  • The Short Title of this Act is The Waimate Municipal Reserves Act 1895.

2 Council may purchase

  • It shall be lawful for the Council of the Borough of Waimate to appropriate from the funds of the municipality such sum as may be necessary to acquire the freehold of the parcels of land described in the Schedule hereto.

3 Commissioner to value

  • The Commissioner of Crown Lands for the Land District of Canterbury shall when called upon by the said Borough Council value the said parcels of land, not including improvements, and, upon the sum of such valuation being paid over by the said Borough Council, a clear title shall issue to the Corporation of the Borough of Waimate in respect of the said parcels of land.

4 Borough Council may let

  • The said Borough Council shall have power to let the said lands or any of them for any term not exceeding twenty-one years.

5 Land not to be dealt with until opportunity afforded to Borough Council to acquire

  • The parcels of land described in the Schedule hereto shall not be sold or otherwise dealt with until opportunity has been afforded to the said Borough Council to acquire the same in accordance with the provisions of this Act.
