An Act to make Provision for the Management of the Masterton Public Park.

  • Preamble

    WHEREAS under the provisions of The Greytown and Masterton Public Park and Cemetery Reserve Management Act 1875, part of section numbered nineteen in the Township of Masterton became and is now vested in the Masterton Park Trustees, a body corporate with perpetual succession, in trust for park purposes, as therein mentioned:And whereas the said land is comprised within the area of the Borough of Masterton: And whereas the annual income derived from the said lands is entirely insufficient and inadequate to enable the Trustees to properly maintain, manage, and improve the same: And whereas it is desirable in the interest of the Masterton Borough and its inhabitants that the said lands should cease to be vested in the Masterton Park Trustees, and should become vested in the Mayor, Councillors, and Burgesses of the Borough of Masterton for the purposes of and to be used as a public park and pleasure-grounds:

BE IT THEREFORE ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title
  • The Short Title of this Act is The Masterton Public Park Management Act 1901.

2 Repeal
3 Land to vest in Mayor, Councillors, and Burgesses of Borough of Masterton
  • On the passing of this Act, the Masterton Park Trustees as a corporate body shall cease to exist, and the said land shall thereupon become vested in the Mayor, Councillors, and Burgesses of the Borough of Masterton in trust for the purposes of public recreation and pleasure-grounds, as provided and defined by The Municipal Corporations Act 1900, section three hundred and fifty-five, without any conveyance or memorandum of transfer of the same.
