  • The Long title was repealed, as from 19 November 1907, by section 2 Statutes Repeal Act 1907 (1907 No 40). It read as follows: An Act to enable the Wellington Hospital Contributors to purchase and otherwise deal with Land for the Purpose of extending the Site and Grounds of the Wellington Hospital and for Sanitary and other Reasons.

  • Preamble

    WHEREAS it has been found necessary to extend the site of the Wellington Hospital for the purpose of erecting new buildings and for sanitary and other reasons, and there may be further necessity for extension of such site:

BE IT THEREFORE ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title
  • The Short Title of this Act is The Wellington Hospital Contributors Empowering Act 1903.

2 Powers that may be exercised by The Wellington Hospital Contributors.
  • It shall be lawful for The Wellington Hospital Contributors, a separate institution incorporated by Order in Council under the provisions of The Hospitals and Charitable Institutions Act 1885, from time to time, with the consent of the Wellington Hospital District Board, to exercise the following powers:—

    • (a) To purchase, either for cash or on deferred payments, or acquire by exchange lands in the immediate neighbourhood of the said Hospital:

    • (b) To sell land to or exchange land with the Mayor, Councillors, and Citizens of Wellington as may be required for street-widening purposes:

    • (c) To take a lease or leases of lands either with or without a clause giving The Wellington Hospital Contributors the right at any time to purchase the freehold of the lands so leased:

    • (d) To mortgage the lands so purchased and the revenues accruing from the same or other lands vested in them, either to the vendor or vendors, or any other person or persons or company, for the purpose of securing or raising the purchase-money or the balance of the purchase-money payable in respect of lands so purchased, and of securing the due payment of interest thereon, and the observance and performance of such covenants or agreements as they may enter into:

    • (e) To execute such contracts, deeds, assurances, and other documents as shall enable them to carry out the above-mentioned purposes or to complete any negotiations or transactions already entered into of the same nature and for the same purposes.

3 Prior acts done by The Wellington Hospital Contributors validated
  • All moneys heretofore paid by The Wellington Hospital Contributors in connection with any of the above purposes shall be deemed to have been lawfully expended, and all transactions entered into or completed by them for the above purposes shall be deemed to have been within their powers.
