Inglewood Town Board Leases Validation Act 1904

An Act to validate certain Leases granted by the Inglewood Town Board.

  • Preamble

    The Preamble was repealed, as from 19 November 1907, by section 2 Statutes Repeal Act 1907 (1907 No 40). It read as follows: WHEREAS by an Order in Council bearing date the ninth day of May, one thousand eight hundred and ninety-eight, sections numbered 189 and 190 on the map of the Town of Inglewood were vested in the Inglewood Town Board in trust for a site for a Public Library and a Mechanics' Institute: And whereas, all of the said land not being immediately required for the purposes aforesaid, the Inglewood Town Board granted unto the persons hereinafter mentioned leases of portions of the said sections for the term of twenty-one years from the first day of October, one thousand eight hundred and ninety-eight, containing covenants that each of the lessees should, within six months from the granting of such leases, erect substantial buildings on the lands comprised in such leases, with a right to remove improvements effected by the lessees, and a right of renewal for a further term of twenty-one years: And whereas the several lessees, relying upon the validity of such leases, and in performance of the covenant to rebuild in each of the said leases, have expended considerable sums of money in erecting buildings on and effecting improvements to the several portions of the said sections respectively held by them: And whereas doubts have arisen as to the power of the said Inglewood Town Board to grant such leases as aforesaid, and it is desirable that such doubts should be set at rest, and the leases aforesaid confirmed and declared valid:.

BE IT THEREFORE ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title
  • The Short Title of this Act is The Inglewood Town Board Leases Validation Act 1904.

2 Validation of leases
  • The leases granted by the Inglewood Town Board to Abel Blake Gamlin, of Inglewood, butcher, of Sub-allotments 1 and 2 of Sections 189 and 190 on the map of the Town of Inglewood, dated the fourteenth day of November, one thousand eight hundred and ninety-eight, and registered in the office of the District Land Registrar at New Plymouth under number four thousand and fifty; and to Joseph Pennington, of Inglewood, settler, of Sub-allotment 4 of the same section, dated the tenth day of October, one thousand eight hundred and ninety-eight, and registered as aforesaid under number four thousand and twenty; and to Nicholas Greiner, of Inglewood, watchmaker, of Sub-allotment 5 of the same sections, dated the tenth day of October, one thousand eight hundred and ninety-eight, and registered as aforesaid under number four thousand and eighteen; and to William John Lile, of Inglewood, butcher, of Sub-allotment 6 of the same sections, dated the tenth day of October, one thousand eight hundred and ninety-eight, and registered as aforesaid under number four thousand and nineteen, are hereby confirmed, and are hereby declared to be in all respects as valid and effectual as though the said Inglewood Town Board had full power to grant and make the same.

3 Application of rents, etc
  • All rents and profits arising from the said Sections 189 and 190 shall be applied solely for the benefit of the Inglewood Public Library.
