Invercargill Cemetery Vesting Act 1905

An Act to vest in the Mayor, Councillors, and Burgesses of the Borough of Invercargill certain Parcels of Land in the Invercargill Hundred in Trust for the Purpose of a Cemetery.

    The Preamble was repealed, as from 19 November 1907, by section 2 Statutes Repeal Act 1907 (1907 No 40).

BE IT THEREFORE ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title
  • The Short Title of this Act is The Invercargill Cemetery Vesting Act 1905.

2 Interpretation
  • In this Act, if not inconsistent with the context, Corporation means the Mayor, Councillors, and Burgesses of the Borough of Invercargill constituted under Local Government Act 1974.

    A reference to the Municipal Corporations Act 1900 was substituted, as from 1 January 1901, for a reference to the Municipal Corporations Act 1886 pursuant to section 433 Municipal Corporations Act 1900 (1900 No 50). That reference was in turn substituted, as from 4 August 1908, by a reference to the Municipal Corporations Act 1908 pursuant to section 1(2) Municipal Corporations Act 1908 (1908 No 124). That reference was in turn substituted, as from 1 April 1921, by a reference to the Municipal Corporations Act 1920 pursuant to section 385(1) Municipal Corporations Act 1920 (1920 No 48). That reference was in turn substituted, as from 20 December 1933, by a reference to the Municipal Corporations Act 1933 pursuant to section 393(1) Municipal Corporations Act 1933 (1933 No 30). That reference was in turn substituted, as from 1 April 1955, by a reference to the Municipal Corporations Act 1954 pursuant to section 413 Municipal Corporations Act 1954 (1954 No 76). That reference was in turn substituted, as from 1 April 1980, by a reference to the Local Government Act 1974 pursuant to section 9(1) Local Government Amendment Act 1979 (1979 No 59).

3 Parcels of land described in the Schedule to vest in the Corporation
  • The parcels of land described in the Schedule hereto are hereby vested in the Corporation in trust for the purpose of a cemetery.


Schedule

ALL that parcel of land in the Southland Land District, containing by admeasurement 20 acres, more or less, being Section No 1 of 43 of Block II, Invercargill Hundred, on the Crown-grant record map of the Invercargill Hundred aforesaid. Bounded towards the north-west by a public road, 819 links; towards the north-east by Section No 2 of 43 of the said block, 2505 links; towards the south-east by Section No 3 of 43 of the said block, 813 links; and towards the south-west by a public road, 2400 links: be all the aforesaid linkages a little more or less.

Also, all that parcel of land in the Southland Land District, containing by admeasurement, exclusive of railway reserve, 10 acres 2 roods 36 perches, more or less, being Section No 3 of 43 of Block II, Invercargill Hundred, on the Crown-grant record map of the Invercargill Hundred aforesaid. Bounded towards the north-west by Section No 1 of 43 and Section No 2 of 43 of the said block, 1510 links; towards the north-east by Section No 42 of the said block, 780 links; towards the south-east by Section No 44 of the said block, 1510 links; and towards the south-west by a public road, 780 links: save and excepting from the above-described area a railway reserve, 1 chain wide, intersecting the same: be all the aforesaid linkages a little more or less.
