Greytown Trustees Empowering Act 1906

An Act to enable the Greytown Trustees to convey certain Lands for Public Purposes.

  • Preamble

    WHEREAS the lands detailed in the Schedules to this Act form part of the lands vested in the present Greytown Trustees pursuant to the provisions of The Masterton and Greytown Lands Management Acts Amendment Act 1883: And whereas it is expedient that the Greytown Trustees should be empowered to convey or transfer the lands described in Schedule 1 to this Act to the Wairarapa District Hospital Board for the purposes of an infectious diseases hospital, and the land described in Schedule 2 to this Act to the Mayor, Councillors, and Burgesses of the Borough of Greytown for the purposes of a municipal town hall:

BE IT THEREFORE ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title
  • The Short Title of this Act is The Greytown Trustees Empowering Act 1906.

2 Power to convey land described in Schedule 1
  • The Greytown Trustees for the time being, as defined by The Masterton and Greytown Lands Management Acts Amendment Act 1883, are empowered to convey or transfer to the Wairarapa District Hospital Board the lands described in Schedule 1 hereto, in trust for the purposes of an infectious diseases hospital; and, in the event of the said lands being no longer required for the purposes of an infectious diseases hospital, in trust to reconvey the same to the Greytown Trustees; and for that purpose the Wairarapa District Hospital Board is hereby authorised and empowered to execute such conveyances or transfers as may be necessary, and such conveyances or transfers shall be valid.

3 Power to convey land described in Schedule 2
  • The Greytown Trustees are also empowered to convey or transfer to the Mayor, Councillors, and Burgesses of the Borough of Greytown the land described in Schedule 2 hereto, in trust for the purposes of a municipal town hall; and, in the event of the said lands being no longer required for the purposes of a municipal town hall, in trust to reconvey the same to the Greytown Trustees; and for that purpose the Council of the Borough of Greytown are hereby authorised and empowered to execute such conveyances or transfers as may be necessary, and such conveyances or transfers shall be valid.

4 Evidence of validity of conveyance
  • A statutory declaration made by any one or more of the Greytown Trustees setting forth that the persons executing any conveyance or transfer under the authority of this Act were the Greytown Trustees at the time of the execution of such conveyance or transfer shall be conclusive evidence for all purposes that such conveyance or transfer has been completely executed by all the Greytown Trustees, and that all the estate and interest of the Greytown Trustees has become vested in the persons or body corporate which may purport to take under such conveyance or transfer.


Schedule 1

ALL that parcel of land situate in the Borough of Greytown, containing 2 acres 1 rood 1 perch, more or less, being the whole of the sections numbered 58, 59, and 60 on the plan of the Town Belt of the Township of Greytown.

Schedule 2

ALL that parcel of land situate in the Borough of Greytown, containing 1 rood 34.7 perches, more or less, being the western half part of Section 61 on the plan of the Township of Greytown: bounded on the north-east by Church Street, 254 links; on the north-west by Main Street, 183.9 links; on the south-west by Section 63 on the said plan, 254 links; and on the south-east by other part of Section 61, 183.9 links; be all the aforesaid linkages a little more or less.
