An Act to declare that certain Private Streets and Private Ways in the Borough of Gore are Streets.

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title

  • This Act may be cited as the Gore Streets Act 1907.

2 Streets declared public streets

  • The private streets and private ways mentioned in the Schedule hereto and situate in the Borough of Gore are hereby declared to be streets within the meaning of the Municipal Corporations Act 1900.

3 Power of Council over such streets

  • The Council of the Borough of Gore may exercise over the said streets and ways all the rights conferred upon Municipal Corporations under the Local Government Act 1974, or any other Act or Acts for the time being in force giving Municipal Corporations power over streets.

    A reference to the Municipal Corporations Act 1908 was substituted, as from 4 August 1908, for a reference to the Municipal Corporations Act 1900 pursuant to section 1(2) Municipal Corporations Act 1908 (1908 No 124). That reference was in turn substituted, as from 1 April 1921, by a reference to the Municipal Corporations Act 1920 pursuant to section 385(1) Municipal Corporations Act 1920 (1920 No 48). That reference was in turn substituted, as from 20 December 1933, by a reference to the Municipal Corporations Act 1933 pursuant to section 393(1) Municipal Corporations Act 1933 (1933 No 30). That reference was in turn substituted, as from 1 April 1955, by a reference to the Municipal Corporations Act 1954 pursuant to section 413 Municipal Corporations Act 1954 (1954 No 76). That reference was in turn substituted, as from 1 April 1980, by a reference to the Local Government Act 1974 pursuant to section 9(1) Local Government Amendment Act 1979 (1979 No 59). See Part 21 Local Government Act 1974 as to roads (other than regional roads), service lanes, and access ways.

4 New buildings on private ways

  • Notwithstanding anything in the Local Government Act 1974, or its amendments, no new building shall, after the passing of this Act, be erected, used, or occupied as a dwellinghouse or as ancillary to a dwellinghouse within the Borough of Gore on land fronting any private way, unless every part of such building is distant at least thirty-three feet from the centre line (as defined by the Council) of such private way, or at least thirty-three feet from the end of any private way having only one outlet, or unless such land abuts on a street or a private street or another private way not less than sixty-six feet wide:

    Provided that this section shall not apply to any building for which a permit has, before the passing of this Act, been granted by the Council.

5 Penalty for unlawful erection of buildings

  • If any person erects any building contrary to the provisions of this Act, such person is liable to a penalty not exceeding four dollars for every day during which such breach continues.

    The words “four dollars” were substituted, as from 10 July 1967, for the words “two pounds” pursuant to section 7(1) Decimal Currency Act 1964 (1964 No 27).

6 Power of Council over part of the Mataura River bed

  • Notwithstanding anything in any Act, the said Council shall have and may exercise over such part of the bed of the Mataura River as lies within the boundary of the Borough of Gore all the powers conferred upon local authorities in respect of streets by the Local Government Act 1974, and the Public Works Act 1981.

That reference was in turn substituted, as from 6 October 1928, by a reference to the Public Works Act 1928 pursuant to section 346 Public Works Act 1928 (1928 No 21). That reference was in turn substituted, as from 1 February 1982, by a reference to the Public Works Act 1981 pursuant to section 248(1) Public Works Act 1981 (1981 No 35).
