An Act to constitute the Waipukurau County.

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title

  • This Act may be cited as the Waipukurau County Act 1907.

2 Constitution of Waipukurau County

  • (1) The Waipukurau Road District is hereby abolished, and the Waipukurau County is hereby constituted, and shall comprise all that area described in Schedule 1 hereto, being part of the Waipawa County.

    (2) The boundaries of the said Waipawa County are hereby altered accordingly, and shall be as described in Schedule 2 hereto; and the part described in Schedule 1 hereto of the said Waipukurau Road District shall be deemed to be merged in the Waipukurau County hereby constituted, and the rest of the said road district shall be deemed to be merged in the Waipawa County.

    (3) The provisions of section fifty-seven of the Counties Act 1886, shall, mutatis mutandis, apply with respect to the merger as aforesaid of the said road district, and the Councils of the Counties of Waipukurau and Waipawa may agree in writing as to the apportionment between them of the property of the Road Board and other subject-matters of the said section, and, failing such agreement being made within two months from the commencement of this Act, such apportionment shall be made by the Controller and Auditor-General, or such other person as the Governor may appoint, and for that purpose the provisions of sections thirty-two, thirty-three, and thirty-four of the said Act shall, mutatis mutandis, apply.

3 Jurisdiction of County Council

  • From and after the coming into operation of this Act, and during the existence of the county hereby constituted, no local body or authority other than the County Council shall within the limits of the said county exercise any jurisdiction or authority over any roads, or over or in relation to any matter or thing in respect of which jurisdiction is conferred upon a County Council under the provisions of the Counties Act 1886, or any amendment thereof, or otherwise:

    Provided that nothing herein shall limit the power of the Governor at any time to proclaim a town district in the said county.

4 Date of commencement of Act

  • This Act shall come into force on the first day of April, nineteen hundred and eight.

Schedule 1

ALL that area in the Hawke's Bay Land District bounded as follows: Commencing at a point being the junction of the centre of the Mangatarata Stream with the Tukituki River; towards the east generally by the centre of the Mangatarata and Tangatupuru Streams to the westernmost corner of Block 87, Waipukurau Crown Grant District; towards the south generally by a line in direct continuation of the south-west boundary of that block to a point in line with the southern boundary of Block 40, by a straight line from that point to the south-east corner of said Block 40, and by the southern boundaries of Blocks 40, 39, and 42 to the centre of the Ngahape Stream; towards the south-east generally and again towards the south generally by the centre-line of that stream to the north-east corner of Section 1, Block XII, Takapau Survey District; again towards the east by the eastern boundary of the said Section 1 to the centre of the Purimu Stream; towards the north by the centre-line of that stream to the north-east corner of Section 2, Block XII, Takapau Survey District; towards the south-east and again towards the south and south-west generally by the south-east boundary of the said Section 2 and the centre-lines of the Tauraekaitai and Whatatuna Streams, the southern boundary of Block 83, Parangahau Crown Grant District, and the centre-line of the Mangapurakau Stream to the south-western corner of Section 1, Block XI, Takapau Survey District; towards the west by the western boundary of the last-mentioned Section 1, and again towards the north by the northern boundary of the said last-mentioned Section 1; towards the west generally by the centre-line of the Maharakeke Stream, the west boundary of Section 9, Block VIII, Takapau Survey District, and again by the centre-line of the said Maharakeke Stream to the right bank of the Makaretu River; again towards the north by the right banks of the Makaretu and Tukituki Rivers; again generally towards the east, north, and west by the western, southern, and eastern boundaries of the Town District of Waipukurau as described in New Zealand Gazette No 95, of the 2nd November, 1905; and again towards the north by the centre-line of the Tukituki River to the commencing-point.

Schedule 2

ALL that area in the Hawke's Bay Land District bounded towards the north generally by Hawke's Bay County as described in the New Zealand Gazette No 73, of the 1st September, 1904, from the summit of the Ruahine Range to the middle of the Waipawa-Te Aute Road; thence towards the east generally by Patangata County as described in the New Zealand Gazette No 92, of the 1st November, 1906, to the middle of the Tukituki River; thence by the Waipukurau County as described in Schedule 1 hereto, to the confluence of the Tauraekaitai and Whatatuna Streams; thence again by the Patangata County aforesaid to Weber County as described in the Schedule to the Weber County Act 1902; thence towards the south generally by the said Weber County to the north-eastern corner of Pahiatua County as described in the Schedule to the Counties Act Amendment Act 1888; thence by the said Pahiatua County to the south-eastern corner of Woodville County as described in the Schedule to the Woodville County Act 1901; thence towards the west and south-west by the said Woodville County to the summit of the Ruahine Range; and thence again towards the west generally by a line along the summit of the said Ruahine Range to the place of commencement: excluding the Borough of Dannevirke.
