Nelson Hospital and Charitable Aid Board Empowering Act 1907

An Act to empower the Nelson Hospital and Charitable Aid Board to sell a certain Parcel of Land in the City of Nelson upon such Terms and Conditions as it thinks fit, and to apply the Proceeds of such Sale in or towards the Erection of an Old People's Home in the said City.

  • Preamble

    WHEREAS the parcel of land described in the Schedule hereto is vested under and by virtue of the Nelson Hospital Reserves Act 1888, in the Nelson Hospital and Charitable Aid Board for the purposes of a general hospital at Nelson, subject to the provisions of the Hospitals and Charitable Institutions Act 1885: And whereas the said parcel of land and the buildings thereon now used for an Old People's Home are unsuitable for such purpose, and the said Board have secured another and more suitable site for the erection of a new building for an Old People's Home, and the said parcel of land will therefore be no longer required for such purpose: And whereas it is desirable and expedient that the said parcel of land should be sold and the proceeds applied by the said Board as hereinafter provided:

BE IT THEREFORE ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows.—

1 Short Title

  • This Act may be cited as the Nelson Hospital and Charitable Aid Board Empowering Act 1907.

2 Interpretation

  • In this Act, if not inconsistent with the context,—

    Board means the Nelson Hospital and Charitable Aid Board as constituted under the Hospitals and Charitable Institutions Act 1885.

3 Power to sell and convey land

  • The Board is hereby authorised—

    • (a) To sell the parcel of land described in the Schedule hereto and the buildings thereon, either together or in lots, by public auction or public tender, for such price and upon such terms and conditions as the Board thinks fit:

    • (b) To execute under the seal of the Board all necessary conveyances, transfers, and assurances of the said parcel of land or any part thereof to the purchaser or purchasers thereof.

4 Application of purchase-moneys

  • All purchase-moneys received by the Board for the sale of the said parcel of land or buildings, or any part thereof, shall be applied in or towards the erection of buildings for an Old People's Home upon the land already acquired for that purpose, being sections numbered 984, 986, and 988 on the map of the City of Nelson.

Schedule

ALL that parcel of land situated in the City of Nelson, containing by admeasurement 1 acre, more or less, being section numbered 662 on the map of the said city: bounded on the south by Examiner Street, on the east by Waimea Street, on the west by Wellington Street, and on the north by section numbered 663.
