Wairau Harbour Board Act 1907

An Act to constitute a Harbour Board for the Harbour of Wairau (Marlborough).

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title

  • This Act may be cited as the Wairau Harbour Board Act 1907.

2 Special Act

  • This Act shall be deemed to be a special Act within the meaning of the Harbours Act 1950, which Act and all Acts amending the same shall be incorporated with this Act.

    The Harbours Act 1878 was consolidated, as from 4 August 1908, by section 1(2) Harbours Act 1908 (1908 No 75). That Act was repealed, as from 1 January 1924, by section 259(1) Harbours Act 1923 (1923 No 40). That Act was in turn repealed, as from 15 October 1950, by section 269(1) Harbours Act 1950 (1950 No 34).

    The term Special act was omitted from the Harbours Act 1950, as from 1 December 1961, by section 2 Harbours Amendment Act 1961 (1961 No 114).

3 Interpretation

  • In this Act, if not inconsistent with the context,—

    Board means the Harbour Board constituted under this Act

    Harbour means the port and harbour of Wairau

    Harbour district means the Wairau Harbour District

    The said Act means the Harbours Act 1950, and all Acts amending the same.

    The Harbours Act 1878 was consolidated, as from 4 August 1908, by section 1(2) Harbours Act 1908 (1908 No 75). That Act was in turn repealed, as from 15 October 1950, by section 269(1) Harbours Act 1950 (1950 No 34).

4 Harbour Board constituted

  • (1) A Harbour Board is hereby constituted under the said Act for the Harbour of Wairau, and such Board shall consist of nine members, of whom four shall form a quorum; and such members shall be appointed and elected as follows:—

    • (a) Three members shall be appointed by the Governor:

    • (b) Three members shall be elected by the electors of the Borough of Blenheim:

    • (c) Two members shall be elected by the electors of the Omak Road District:

    • (d) One member shall be elected by all persons who in the year preceding the day of election have paid a sum of not less than six dollars as harbour dues, port, harbour, pilotage, or wharfage rates, dues, or charges levied at or in respect of the harbour.

    (2) At any such election each voter shall have one vote and no more.

    The reference in subsection (1)(d) to “six dollars” was substituted, as from 10 July 1967, for a reference to “three pounds” pursuant to section 7(1) Decimal Currency Act 1964 (1964 No 27).

5 Election of members of Board

  • The first elective members of the Board shall be elected on a day to be fixed by the Governor, and shall hold office until the second Monday in February, nineteen hundred and ten, on which day their successors shall be elected; and thereafter an election of members shall be held on the second Monday in February in every alternate year.

6 Returning Officer

  • (1) The Governor may, by Order in Council gazetted, appoint a Returning Officer and polling-places for the purpose of the first election of members under this Act, and a day for such election, and may make such further provision for the same purpose as he deems necessary.

    (2) Elective members of the Board shall be elected under the provisions of the Local Elections Act 1904.

7 Endowments

  • The Board is hereby endowed with all wharfage, pilotage, dues, rates, and port charges in the Harbour of Wairau.

8 Power to borrow

  • (1) The Board shall have power from time to time to borrow, subject to the provisions of the said Act, any sum not exceeding ten thousand dollars for the construction or completion of harbour-works in or towards the improvement of the said harbour; but no money shall be borrowed under the authority of this Act which shall produce to the lender a higher rate of interest than five dollars per centum per annum.

    (2) Such moneys shall be raised in the manner prescribed by the Local Bodies Loans Act 1901, and the provisions of that Act shall apply as if the Board were a local authority and the said works were public works within the meaning of Part 1 of that Act.

    (3) At any poll taken on a proposal to raise any such money every ratepayer of the harbour district shall be entitled to one vote and no more.

    The references to “ten thousand dollars”, and “five dollars” were substituted, as from 10 July 1967, for references to “five thousand pounds”, and “five pounds” pursuant to section 7(1) and (2) Decimal Currency Act 1964 (1964 No 27).

9 Wairau Harbour District

  • The Wairau Harbour District shall comprise the Borough of Blenheim and the Omaka Road District.
