An Act to authorise the Disposal of certain Land at Palmerston North.

  • Preamble

    WHEREAS by Order in Council dated the first day of June, eighteen hundred and eighty-six, and published in the Gazette of the third day of June, eighteen hundred and eighty-six, all that parcel of land in the Provincial District of Wellington, situate in the Manawatu District, being Suburban Sections Nos 307 and 308 on the plan of the Town of Palmerston North, containing approximately nine acres two roods, was vested in the Manawatu and West Coast Agricultural and Pastoral Association in trust as a site for an agricultural and pastoral show-ground: And whereas it has been agreed between the Minister of Agriculture and the said association that the association shall transfer to His Majesty the King a portion of the said land, containing approximately two roods sixteen perches, as described in Schedule 1 hereto, for the purposes of a dairy school and dairy experimental station: And whereas the land described in Schedule 2 hereto is vested for an estate in fee-simple in the Manawatu and West Coast Agricultural and Pastoral Association, and the said association has agreed to transfer the same to His Majesty the King for the purposes aforesaid: And whereas, in consideration of the premises, it has been further agreed between the said association and the Minister of Agriculture that part of the residue of the said Sections Nos 307 and 308, being approximately equal in value to the land described in Schedule 2 hereto, should be released from the trust by virtue of which it is held as a site for an agricultural and pastoral show-ground, and should remain vested in the said association free from any trust:

BE IT THEREFORE ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title

  • This Act may be cited as the Palmerston North Dairy School Reserve Act 1908.

2 Manawatu and West Coast Agricultural and Pastoral Association empowered to transfer lands to Crown

  • The Manawatu and West Coast Agricultural and Pastoral Association is hereby authorised and empowered to transfer to His Majesty the King the lands described in Schedules 1 and 2 hereto, free from all trusts affecting the same; and on such transfer the said lands shall be deemed to be a reserve for the purposes of a dairy school and dairy experimental station, and shall be subject to the provisions of the Public Reserves and Domains Act 1908, accordingly.

3 Governor may discharge from trusts certain land held by association

  • (1) It shall be lawful for the Governor, by Order in Council, in consideration of the aforesaid transfer, to discharge from all trusts affecting the same such part of the residue of the said sections numbered 307 and 308 on the plan of the Town of Palmerston North as the Governor deems equal in value to the land described in Schedule 2 hereto.

    (2) Any such Order in Council shall be sufficient authority to the District Land Registrar to register the said association as the proprietor in fee-simple, free from any trust, of the land affected by that Order in Council, and to issue to the association a certificate of title under the Land Transfer Act 1908, accordingly.

Schedule 1

ALL that area in the Borough of Palmerston North, containing by admeasurement 2 roods 16 perches, more or less, being parts of Sections Nos 307 and 308: bounded by a line commencing at a point on the north-western side of Cuba Street, distant 64828.2 links south and 48332.72 links east from Mount Stewart Trig Station; thence north-westerly, bearing 329° 42′ 53″, distance 300 links; thence south-westerly, bearing 239° 42′ 53″, distance 200 links; thence south-easterly, bearing 149° 42′ 53″, distance 300 links, to the north-western side of Cuba Street; and thence north-easterly along the north-western side of Cuba Street, 200 links, to the place of commencement.

Schedule 2

ALL that area in the Borough of Palmerston North, containing by admeasurement 3 roods 24 perches, more or less, being Allotment No 7 of Section 295: bounded towards the north-east by Oakley Street; towards the south-east by Allotment No 6; towards the south-west by Allotment No 15; and towards the north-west by Allotment No 8.
