An Act to vest in the Otago Hospital Board, as an Endowment for Hospital Purposes, a Portion of certain Lands at present vested in the Mayor, Councillors, and Burgesses of the Borough of Kaitangata as an Endowment in Aid of the Borough Funds.
WHEREAS the pieces of land hereinafter described in Schedule A are vested in the Mayor, Councillors, and Burgesses of the Borough of Kaitangata as an endowment in aid of the borough funds: And whereas the Kaitangata Borough Council (hereinafter called the Borough Council) entered into an agreement with the Otago Hospital Board (hereinafter called the Hospital Board) that the Hospital Board should erect a Hospital on the said piece of land described in Schedule B, being part of the land described in Schedule A, and that such Hospital should be maintained and controlled by the Hospital Board; and in consideration thereof the Borough Council agreed to make a contribution to the said Hospital, and to take immediate steps to have the said piece of land described in Schedule B vested in the Hospital Board for hospital purposes: And whereas the said pieces of land described in Schedule A are leased to the New Zealand Coal and Oil Company (Limited) (hereinafter called the company) under memorandum of lease registered number 1668: And whereas it is greatly to the benefit of the company that the said Hospital should be established at Kaitangata: And whereas the company agreed that in consideration of the Hospital Board erecting the said Hospital the company would make a contribution towards the maintenance of the said Hospital, and also would release the piece of land described in Schedule B from the said memorandum of lease: And whereas the Hospital Board has erected the said Hospital on the said piece of land, and the Borough Council and the company are now desirous that the said piece of land should be vested in the Hospital Board for hospital purposes freed from the said memorandum of lease to the company:
BE IT THEREFORE ENACTED by the General Assembly of, New Zealand in Parliament assembled, and by the authority of the same, as follows:—
