Otago Hospital Board Kaitangata Reserve Vesting Act 1909

An Act to vest in the Otago Hospital Board, as an Endowment for Hospital Purposes, a Portion of certain Lands at present vested in the Mayor, Councillors, and Burgesses of the Borough of Kaitangata as an Endowment in Aid of the Borough Funds.

  • Preamble

    WHEREAS the pieces of land hereinafter described in Schedule A are vested in the Mayor, Councillors, and Burgesses of the Borough of Kaitangata as an endowment in aid of the borough funds: And whereas the Kaitangata Borough Council (hereinafter called the Borough Council) entered into an agreement with the Otago Hospital Board (hereinafter called the Hospital Board) that the Hospital Board should erect a Hospital on the said piece of land described in Schedule B, being part of the land described in Schedule A, and that such Hospital should be maintained and controlled by the Hospital Board; and in consideration thereof the Borough Council agreed to make a contribution to the said Hospital, and to take immediate steps to have the said piece of land described in Schedule B vested in the Hospital Board for hospital purposes: And whereas the said pieces of land described in Schedule A are leased to the New Zealand Coal and Oil Company (Limited) (hereinafter called the company) under memorandum of lease registered number 1668: And whereas it is greatly to the benefit of the company that the said Hospital should be established at Kaitangata: And whereas the company agreed that in consideration of the Hospital Board erecting the said Hospital the company would make a contribution towards the maintenance of the said Hospital, and also would release the piece of land described in Schedule B from the said memorandum of lease: And whereas the Hospital Board has erected the said Hospital on the said piece of land, and the Borough Council and the company are now desirous that the said piece of land should be vested in the Hospital Board for hospital purposes freed from the said memorandum of lease to the company:

BE IT THEREFORE ENACTED by the General Assembly of, New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title
  • This Act may be cited as the Otago Hospital Board Kaitangata Reserve Vesting Act 1909.

2 Vesting of lands in Schedule B
  • On the passing of this Act the land described in Schedule B shall, without any conveyance or other assurance, vest in the Otago Hospital Board freed from the existing trusts and from the said memorandum of lease registered number 1668, and shall be held in future as a reserve for hospital purposes.

3 District Land Registrar to cancel existing certificate and issue fresh ones
  • The District Land Registrar of the District of Otago shall cancel the certificate of title of the land described in Schedule A, and on the request of the Otago Hospital Board shall, without charge, issue a new certificate of title to the Hospital Board for the land described in Schedule B, and such certificate shall state that the said piece of land is vested in the Hospital Board for hospital purposes; and also, on the request of the Kaitangata Borough Council, shall issue a new certificate of title to the Borough Council for the balance of the said land described in Schedule A, subject to the trusts and incumbrances declared in or noted on the old certificate of title respecting the said land.


Schedule A

ALL those parcels of land, containing together 82 acres 1 rood 2 perches, more or less, situated in the Town of Kaitangata, being Sections 1, 2, 3, 4, 5, Block LXXV; Sections 1, 2, 3, 4, 5, 6, 7, 8, 9, 12, 13, 14, 15, 16, 17, 18, 19, Block LXXVI; Sections 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 24, 25, Block LXXVII, on the public map of the said town deposited in the office of the Chief Surveyor, Dunedin.

Schedule B

ALL that area in the Otago Land District, containing by admeasurement 1 acre 1 rood 11.2 perches, more or less, being part of Section 3, Block LXXV, Town of Kaitangata: bounded towards the north-west by Wangaloa Road, 408.8 links; towards the north-east by a right line bearing 157° 35′, distance 338 links; towards the south-east by a right line bearing 221° 3′, distance 259.4 links; towards the south-west by Exmouth Street, 308 links; and again towards the north-west by Section 2 of said Block LXXV, 149.2 links; as the same is delineated on the map of the Town of Kaitangata deposited in the office of the Chief Surveyor at Dunedin.
