Waitara Borough Reserves Vesting Act 1909

An Act to vest certain Lands in the Corporation of the Mayor, Councillors, and Burgesses of the Borough of Waitara as an Endowment for the Waitara Public Library.

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title
  • This Act may be cited as the Waitara Borough Reserves Vesting Act 1909.

2 Lands vested in the Corporation of the Borough of Waitara
  • Upon the passing of this Act the lands described in the Schedule hereto shall be and the same are hereby declared to be vested in the Corporation of the Mayor, Councillors, and Burgesses of the Borough of Waitara for an estate in fee-simple, in trust as an endowment for the maintenance of the Waitara Public Library; and the District Land Registrar at New Plymouth shall on the request of the Waitara Borough Council issue to the said Council a Land Transfer certificate of title for the said lands.

3 Power to lease
  • The said Council may from time to time lease all or any part of the said lands for such terms of years, to take effect in possession, and upon such terms and conditions generally as the Council shall think fit, subject, however, to the provisions of the Municipal Corporations Act 1908.

4 How rents dealt with
  • All rents reserved under the leases authorised by this Act shall from time to time, as they are received by or on behalf of the said Council, be paid into such bank as the Council shall appoint; and the Council shall keep a separate account of such rents, to be called the Library Account, and shall from time to time apply such rents in the purchase of books and periodicals, or otherwise in and towards the maintenance and equipment of the Waitara Public Library.

5 Repeal
  • That portion of the Schedule to the Public Reserves Sale Act 1888, relating to Sections 5, 6, 7, 8, 9, 10, and 12, Waitara East (Town), containing one acre three roods (being part of the lands described in the Schedule hereto), is hereby repealed.


Schedule

ALL that piece of land, situate in the Town of Waitara East, containing by admeasurement 1 acre 3 roods, be the same a little more or less, being and comprising the sections numbered 5, 6, 7, 8, 9, 10, and 12 of block numbered XX on the public map of the said town.

All that piece of land, situate in the Town of Waitara West, containing by admeasurement 2 roods, be the same a little more or less, being and comprising the sections numbered 10 and 12 of block numbered XLIV on the public map of the said town.

All that piece of land, situate in the Town of Waitara West, containing by admeasurement 2 roods 35.5 perches, be the same a little more or less, being part of the block numbered CXVI on the public map of the said town. Commencing at a point distant 126.12 links in a north-west direction, on a bearing of 327° 56′, from the south-western corner of the said Block CXVI, and bounded then towards the south-east, on a bearing of 57° 56′ from the said point, by other part of the same block, 199.75 links; thence towards the north-east, on a bearing of 316° 18′, by West Quay, 490.55 links; thence towards the north-west, on a bearing of 237° 56′, by other part of the same block (being the land comprised in certificate of title, Vol xlviii, folio 124, of the books of the District Land Registrar at New Plymouth), 100.82 links; thence towards the south-west, on a bearing of 147° 56′, by Queen Street, 480.35 links, to the commencing-point.
