New Plymouth Recreation and Racecourse Reserve Amendment Act 1910

An Act to amend the New Plymouth Recreation and Racecourse Reserve Act 1887.

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title
  • This Act may be cited as the New Plymouth Recreation and Racecourse Reserve Amendment Act 1910.

2 Corporation to have powers under Public Bodies Leases Act 1908
  • With respect to the land described in the Schedule hereto the Corporation is hereby declared to be a leasing authority under the Public Bodies' Leases Act 1908.

3 Lessee may build upon land
  • Notwithstanding anything contained in the Municipal Corporations Act 1908, the Corporation may, with respect to the said land, exercise all or any of the powers exercisable by a leasing authority under the Public Bodies' Leases Act 1908, but so nevertheless that no lease or underlease shall be granted or permitted by the Corporation by which any less area than one rood, or any greater area than five roods, shall be leased.

4 400 per annum of revenue to be applied in aid of public reserves, etc
  • The Corporation shall, out of the revenue derived from the leasing of the said lands, in the first place pay or retain all expenses incurred by the Corporation in the exercise of the powers hereby conferred or incidental thereto, and pay one-half of the residue of such revenue to the Board of Trustees appointed under the Taranaki Botanic Garden Act 1876, to be expended by such Board in, upon, or about the lands vested in it for a botanic garden and public recreation-grounds, and expend the remaining half in, upon, or about the lands in or contiguous to the Borough of New Plymouth to which the inhabitants of the borough have for the time being the right of access for public recreation, or in acquiring other land for recreation purposes.

    The expression 400 was substituted, as from 10 July 1967, for the expression 200 pursuant to section 7(1) Decimal Currency Act 1964 (1964 No 27).

5 Land not to be subject to the New Plymouth Recreation and Racecourse Reserve Act 1887
  • From and after the passing of this Act the said land shall cease to be subject to the provisions of the New Plymouth Recreation and Racecourse Reserve Act 1887.


Schedule

ALL that parcel of land in the Town of New Plymouth, containing by admeasurement 12 acres 2 roods 15 perches, more or less: bounded towards the north by Hendrie Street, 760 links; towards the east by allotment marked F on the plan of the Town Belt, 550 links, 9 links, and 795 links; towards the south by the last-mentioned allotment and by town allotment numbered 1927, 250 links; again towards the east by the last-mentioned allotment, 205 links; towards the south by allotment marked E on the plan of the Town Belt, 93 links; again towards the east by the last-mentioned allotment, 345 links; again towards the south by the said allotment marked E, 408 links; and towards the west by Eliot Street, 1895 links.
