Ross Borough Council Vesting and Empowering Act 1911

An Act to vest certain Crown Land situate in Blocks I and II of the Totara Survey District in the Mayor, Councillors, and Burgesses of the Borough of Ross.

  • Preamble

    WHEREAS the land described in the Schedule hereunder written is held by the Mayor, Councillors, and Burgesses of the Borough of Ross and by certain other persons under The Land Act 1908, and The Mining Act 1908: And whereas the Mayor, Councillors, and Burgesses of the Borough of Ross are desirous of having the whole of the said land, with the exception of the lands hereinafter mentioned, vested in them: And whereas in respect of all titles held under The Mining Act 1908, it is expedient that the Warden shall continue to exercise jurisdiction as hereinafter set forth: And whereas it is expedient to vest the said land in the said Mayor, Councillors, and Burgesses of the Borough of Ross:

BE IT THEREFORE ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title
  • This Act may be cited as the Ross Borough Council Vesting and Empowering Act 1911.

2 Interpretation
  • In this Act the Corporation means the Mayor, Councillors, and Burgesses of the Borough of Ross.

3 Vesting lands in Mayor, Councillors, and Burgesses of the Borough of Ross
  • All that parcel of land (hereinafter called the said parcel of land) described in the Schedule hereunder written is hereby vested in the Corporation as an endowment.

4 Saving of Warden's jurisdiction
  • Notwithstanding the vesting of the said parcel of land in the Corporation, the Warden for the time being of the Westland Mining District shall continue to have and exercise all the powers conferred upon him by The Mining Act 1908, and its amendments; and all the provisions of The Mining Act 1908, and its amendments, shall apply to and may be exercised over the same:

    Provided also that the vesting of the said parcel of land as aforesaid shall be subject to all legal rights and mining privileges existing at the commencement of this Act.

5 Revenue to belong to District Fund
  • All revenue to be derived from the said parcel of land shall be payable into the District Fund of the Ross Borough Council.

6 Issue of certificate of title
  • The deposit in the office of the District Land Registrar at Hokitika of a plan of the said parcel of land made and certified by a duly authorized surveyor, as required by The Land Transfer Act 1908, together with a copy of this Act, shall be sufficient authority to the said District Land Registrar for the issue of a certificate of title to the said parcel of land in the name of the Corporation, subject to all exceptions hereinbefore mentioned.


Schedule

  • The Schedule was amended, as from 26 October 1912, by section 2 Ross Borough Council Vesting and Empowering Amendment Act 1912 (1912 No 10(L)) by substituting the words Area of endowment, 450 acres 2 roods 12 perches, for the words Area of endowment, 350 acres 2 roods 12 perches,.

All that area of land within the Borough of Ross bounded as follows: Commencing at tube XIV on the south-western boundary of the Ross Borough near the Mikonui Lagoon; thence along the south-western boundary of the said Ross Borough at a bearing of 142° 50′, a distance of 2893 links; thence at a bearing of 60° 22′, a distance of 5335.5 links; thence at a bearing of 112° 35′, a distance of 4758 links; thence at a bearing of 89° 50′, a distance of 2262.7 links; thence at a bearing of 60° 58′, a distance of 537.2 links; thence at a bearing of 323° 57′, a distance of 2694.2 links; thence at a bearing of 54°, a distance of 1100 links; thence at a bearing of 324°, a distance of 4627.5 links; thence at a bearing of 234°, a distance of 1000 links; thence at a bearing of 324°, a distance of 105 links; thence at a bearing of 234°, a distance of 250 links; thence at a bearing of 324°, a distance of 1201.8 links; thence along the south-eastern boundary of Railway Reserve No 9, a distance of 9420 links; thence at a bearing of 322° 7′, a distance of 582 links; thence at a bearing of 232° 58′, a distance of 714 links, to the commencing-point: excepting thereout all freehold and leasehold lands owned or held by any person other than the Corporation, and excepting also the railway reserve. Area of endowment, 450 acres 2 roods 12 perches, more or less, inclusive of road reserves.
