Wellington Harbour Board Empowering Act 1912

An Act to remove certain Restrictions from Land at Worser Bay vested in the Board and to confer certain Powers upon the Board.

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title
  • This Act may be cited as the Wellington Harbour Board Empowering Act 1912.

2 Removal of certain restrictions on land at Worser Bay
  • (1) The restrictions imposed on the Wellington Harbour Board by section five of the Wellington Harbour Board and Corporation Land Act 1880, with respect to the alienation by way of lease of certain lands mentioned in that section shall not apply with respect to the lands mentioned in Schedule 1 hereto, and with regard to those lands the Board shall have the same powers of leasing as it has with regard to lands vested in it without restriction.

    (2) The Board may dedicate as a public road such portions of the lands mentioned in the said section five as it deems necessary for the purposes of such leasing.

3 Power to lease land to Borough of Miramar
  • (1) The said Board shall have power to and shall grant a lease to the Corporation of the Borough of Miramar (hereinafter referred to as the lessee) of the land described in Schedule 2 hereto at an annual rent of one peppercorn for a term of nine hundred and ninety-nine years, subject to the payment by the lessee of all rates and taxes payable in respect of the said land, and subject also, in the event of the whole or any part of the said land being required by the Board for harbour purposes, to the right of the Board at any time to resume possession of the land so required.

    (2) The land so leased shall at all times during the currency of the lease be held by the lessee for the purposes of public recreation, or of assisting and encouraging the sports of swimming, boating, fishing, and sailing.

ALL that area, being part of Section 8 of the Watts Peninsula District, in the Borough of Miramar, containing by admeasurement 5 acres and 34.6 perches: commencing at the south-western corner of the Wellington Harbour Board's Reserve at Worser Bay, distant about 399.6 links from high-water mark; thence 891.4 links on a bearing of 14° 31′ 30″, thence 43.6 links on a bearing of 103° 49′, thence 472.7 links on a bearing of 22° 26′, thence 176.7 links on a bearing of 32° 10′ 30″, thence 171.4 links on a bearing of 104° 31′ 30″, thence 167.9 links on a bearing of 216° 44′, thence 229.2 links on a bearing of 144° 55′, thence 117.8 links on a bearing of 87° 33′, thence 175.7 links on a bearing of 187° 48′, thence 242.1 links on a bearing of 167° 59′, thence 192.6 links on a bearing of 251°, thence 127.5 links on a bearing of 240° 39′, thence 426.3 links on a bearing of 230° 57′, thence 218.6 links on a bearing of 206° 56′ 30″, thence 119.1 links on a bearing of 184° 40′, thence 153.1 links on a bearing of 284° 31′ 30″ to the starting point: be the said area, bearings, and distances a little more or less: as the same is delineated on a plan deposited in the office of the Marine Department, in Wellington, and marked M D 3887.

Schedule 2

ALL that area, being part of Section 8 of the Watts Peninsula District, in the Borough of Miramar, containing by admeasurement 2 acres 3 roods 11.8 perches: commencing at a point on the high-water mark of Port Nicholson in line with the southern boundary of the Wellington Harbour Board's reserve at Worser Bay; thence about 145 links on a bearing of 284° 31′ 30″, thence 116.79 links on a bearing of 4° 40′, thence 177.65 links on a bearing of 26° 56′ 30″, thence 396.55 links on a bearing of 50° 57′, thence 69.66 links on a bearing of 60° 39′, thence 24.97 links on a bearing of 325° 9′, thence 41 links on a bearing of 55° 9′, thence 29.1 links on a bearing of 145° 9′, thence 340.24 links on a bearing of 71°, thence 136.67 links on a bearing of 51°, thence 400.86 links on a bearing of 358° 29′, thence 162.28 links on a bearing of 11° 7′ 30″, thence about 90 links on a bearing of 104° 31′ 30″ to high-water mark of Port Nicholson; thence generally in a southerly and south-westerly direction along high-water mark of Port Nicholson to the starting-point: be the said area, bearings, and distances a little more or less: as the same is delineated on a plan deposited in the office of the Marine Department, in Wellington, and marked M D 3887.
