Tauranga Foreshore Vesting and Endowment Act 1915

An Act to vest certain Lands in the Bay of Plenty Harbour Board.

  • Bay of Plenty Harbour Board and Bay of Plenty Harbour District were substituted, as from 24 August 1970, by section 2(5) Bay of Plenty Harbour Board Act 1970 (1970 No 5(L)) for references to Tauranga Harbour Board and Tauranga Harbour District.

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title
  • This Act may be cited as the Tauranga Foreshore Vesting and Endowment Act 1915.

2 Special Act
  • This Act shall be deemed to be a special Act within the meaning of The Harbours Act 1908.

3 Vesting foreshore in Bay of Plenty Harbour Board
  • On the passing of this Act the whole of the foreshore of the Tauranga Harbour as described in Schedule 1 hereto shall vest in the Tauranga Harbour Board, subject to the right of resumption by the Crown hereinafter mentioned.

    Bay of Plenty Harbour Board and Bay of Plenty Harbour District were substituted, as from 24 August 1970, by section 2(5) Bay of Plenty Harbour Board Act 1970 (1970 No 5(L)) for references to Tauranga Harbour Board and Tauranga Harbour District.

4 Compensation for injury to lands abutting on foreshore
  • (1) The Board shall be liable to pay compensation to the owner of any land abutting on the foreshore of the harbour in respect of any loss or injury suffered by such owner by reason of—

    • (a.) The means of access from such land to the waters of the harbour being materially affected by any works executed or authorized by the Board; or

    • (b.) The free use of the foreshore fronting such land being materially affected by any such works.

    (2) The amount of such compensation shall, in default of agreement between the parties, be determined in the manner provided by The Public Works Act 1908.

5 Vesting lands in Schedule 2 in Tauranga Harbour Board as reserve and endowment lands
  • (1) On the passing of this Act the lands described in Schedule 2 hereto shall vest in the Bay of Plenty Harbour Board.

    (2) Such of the said lands as are reserved for any purpose shall be held by the Board in trust for the purpose for which they were reserved, and such of the said lands as are not so reserved shall be held by the Board as endowments:

    Provided that of the land described in paragraph C of the said Schedule 2 an area not exceeding ten acres (to be hereafter located by the Chief Surveyor) shall be set apart as a landing-station, and the remainder of the said land shall be held by the Board as an endowment.

6 Issue of Crown grants or certificates of title to Board
  • The Governor is hereby empowered to sign a warrant or warrants authorizing the issue of Crown grants or certificates of title, as the case may require, for the said foreshore and lands or any part thereof to and in favour of the Board, subject to and provided that any portion of the said foreshore so vested as aforesaid may be resumed by the Crown at any time for any public work or public purpose without compensation, except that compensation shall be payable and assessed in manner provided by The Public Works Act 1908, for wharves, buildings, or permanent improvements made and effected by the Board or any lessee of any of said lands so resumed.


Schedule 1

ALL the foreshore of the Tauranga Harbour commencing at the north head, Katikati entrance, and thence following the mainland to the headland at Mount Maunganui opposite the Beacon Rock at the Tauranga entrance to the harbour; as shown on the plan deposited in the office of the Chief Surveyor at Auckland, as No 18315 (blue), and thereon edged blue.

Schedule 2

A. ALL that parcel of land, situated in the Parish of Tahawai, County of Tauranga, containing by admeasurement 1 acre, more or less, and being the north-east portion of Allotment 2 of said parish: bounded on the north by a road, 275 links; on the west by other part of said allotment, 250 links; on the south by other part of said allotment, 520 links; and on the east by the Tauranga Harbour: as shown on the plan deposited in the office of the Chief Surveyor at Auckland, numbered 18315 (blue), and thereon coloured red.

B. All that parcel of land, situated in the Parish of Tahawai aforesaid, containing by admeasurement 5 acres, more or less, being Allotment 10A of said parish: bounded on the north-west by a road, 310 links; on the south-west by Allotment 10 of said parish and a road reserve, 670 links; and on south-east, east, north, and north-west by Tauranga Harbour: as shown on the plan deposited in the office of the Chief Surveyor at Auckland, numbered 18315 (blue), and thereon coloured red.

C. All that parcel of land, situated in the Parish of Tahawai aforesaid, containing by admeasurement 80 acres, more or less, and being Allotment 76 of said parish: bounded on the south-east by a road, 2620 links; and on the east, north-east, north, north-west, and west by Tauranga Harbour: as shown on the plan deposited in the office of the Chief Surveyor at Auckland, numbered 18315 (blue), and thereon coloured red.

D. All that parcel of land, situated in the Parish of Te Mania, in the County of Tauranga, containing by admeasurement 10 acres, more or less, and being Allotment 31A of said parish: bounded on the south-east by a road, 830 links; on the north-east by Allotment 31 of said parish, 1275 links; on the north-west by Allotment 31 aforesaid, 865 links; and on the south-west by Aongatete River: as shown on the plan deposited in the office of the Chief Surveyor at Auckland, numbered 18315 (blue), and thereon coloured red.

E. All that parcel of land, situated in the Parish of Te Mania aforesaid, containing by admeasurement 3 acres and 32 perches, more or less, being Allotment 40 of said parish: bounded on the south-east by Allotment 41 of said parish, 1016 links; and on the north-east, north, north-west, and west by Tauranga Harbour: as shown on plan deposited in the office of the Chief Surveyor at Auckland, numbered 18315 (blue), and thereon coloured red.

F. All that parcel of land, situated in the Parish of Apata, in the County of Tauranga, containing by admeasurement 2 acres, more or less, being Allotment 133 of said parish: bounded on the south-east by Allotment 207 of said parish, 770 links; on the north-east by Tauranga Harbour; and on the north-west by a road, 972 links, more or less: as shown on plan deposited in the office of the Chief Surveyor at Auckland, numbered 18315 (blue), and thereon coloured red.

G. All that parcel of land, situated in the Parish of Apata aforesaid, containing by admeasurement 1 acre 1 rood, more or less, being Allotment 215 of said parish: bounded on the north-west by Allotment 214 of said parish, 300 links; on the south-west by a road, 445 links; on the south-east by Allotment 140 of said parish, 280 links; and on the north-east by the tidal waters of the Aongatete River: as shown on plan deposited in the office of the Chief Surveyor at Auckland, numbered 18315 (blue), and thereon coloured red.

H. All that parcel of land, situated in the Parish of Apata aforesaid, containing by admeasurement 1 acre and 20 perches, more or less, being Allotment 216 of said parish: bounded on the east by a road; on the north by the Tauranga Harbour; and on the west by Allotment 140 of said parish, 760 links: as shown on plan deposited in the office of the Chief Surveyor at Auckland, numbered 18315 (blue), and thereon coloured red.

I. All that parcel of land, situated in the Parish of Te Puna, in the County of Tauranga, containing by admeasurement 4 acres, more or less, being western part of Allotment 181 of said parish: bounded on the east by a road, 285, 526, and 1017 links; on the north by a road, 47.1 links; on the west by Allotment 182, 1619 links; and the south by Allotment 182, 410 links: as shown on plan deposited in the office of the Chief Surveyor at Auckland, numbered 18315 (blue), and thereupon coloured red.

J. All that parcel of land, situated in the Parish of Te Puna aforesaid, containing by admeasurement 1 acre and 5 perches, more or less, being Allotment 237 of said parish: bounded on the north-west by a road, 225.8 links; on the northeast by a road, 225.1, 127.4, and 267 links; on the east by a road, 22 links; and on the south-west by Allotment 215 of the said parish, 680.7 links: as shown on plan deposited in the office of the Chief Surveyor at Auckland, numbered 18315 (blue), and thereon coloured red.

K. All those parcels of land, situated in the Parish of Te Papa, containing by admeasurement 5 acres 2 roods, more or less, being Allotment 7 of said parish: bounded on north-west by Allotment 110 of said parish, 1050, 650, and 1820 links; on the south-west by a road, 120 links; and on the east, south-east, and north-east by Tauranga Harbour: as shown on plan deposited in the office of the Chief Surveyor at Auckland, numbered 18315 (blue), and thereon coloured red.

L. All that parcel of land, situated in the Town of Tauranga, containing by admeasurement 1 acre 1 roods, more or less, being Allotment 343, Section 1, of said town: bounded on the north-west by Allotment 344, 340 links; on the west by Tauranga Harbour; on the south-east by Allotments 343A and 343B, 419 links; and on the north-east by a road, 326 links: as shown on plan deposited in the office of the Chief Surveyor at Auckland, numbered 18315 (blue), and thereon coloured red.

M. All that parcel of land, situated in the Town of Tauranga, containing by admeasurement 2 roods, more or less, being Allotment 344, Section 1, of said town: bounded on the north-east by a road, 200 links; on the north and north-west by Tauranga Harbour; and on the south-east by Allotment 343, 340 links: as shown on plan deposited in the office of the Chief Surveyor at Auckland, numbered 18315 (blue), and thereon coloured red.

N. All that piece of land, situated in the Tauranga Survey District, containing by admeasurement 2 acres and 2 perches, more or less, being Allotment 2, Block VI, of said survey district: bounded on the south-east by a road, 488.4 links; on the north-east by Mount Maunganui Domain, 450 links; on the north-west by the said domain, 484 links; and on the south-west by said domain, 447.5 links: as shown on plan deposited in the office of the Chief Surveyor at Auckland, numbered 18315 (blue), and thereon coloured red.

O. All that parcel of land, situated in the Tauranga Survey District, containing by admeasurement 9 acres 2 roods 16 perches, more or less, being Allotment 1, Block VII, of said survey district: bounded on the south by a road, 548.4 links; on the south-east by a road, 873 links; on the north-east by a road, 615.7 links; on the north-west by Lot 7, 865.6 links; and on the south-west by a road, 4.6, 512.6, and 17.8 links: as shown on plan deposited in the office of the Chief Surveyor at Auckland, numbered 18315 (blue), and thereon coloured red.
