An Act to confer on the Auckland City Council certain Powers in regard to the Collection of Books and Manuscripts known as the Grey Collection and held in Trust to the Use of the Citizens of Auckland.

  • Preamble

    WHEREAS the collection of books and manuscripts in the Auckland Public Library known as the Grey Collection was presented by the late Sir George Grey for the use of the citizens of Auckland and vested in the Council of the City of Auckland in trust for that purpose: And whereas by an Act of the Legislature of the Union of South Africa, entitled the Grey Collection Act 1921, the Board of Trustees of the South African Public Library is empowered to transfer certain books and manuscripts in its possession, formerly belonging to the late Sir George Grey and relating to the Maoris of New Zealand and to Polynesia, to the Government of New Zealand in exchange for certain books and manuscripts relating to South Africa and its people and included in the aforesaid Grey Collection in the Auckland Public Library: And whereas it is desirable that such exchange should be effected, and that the Auckland City Council should, notwithstanding any conditions of the trust aforesaid, be empowered to transfer the said books and manuscripts relating to South Africa and its people to the said Board of Trustees, and to receive in exchange on behalf of the New Zealand Government, and to hold in trust for the people of New Zealand, the said books and manuscripts relating to the Maoris of New Zealand and to Polynesia:

BE IT THEREFORE ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title
  • This Act may be cited as the Grey Collection Exchange Act 1921.

2 Auckland City Council may transfer certain books and manuscripts in Grey Collection
  • (1) Anything to the contrary notwithstanding in the conditions of the trust imposed on it by the late Sir George Grey, the Auckland City Council may transfer to the Board of Trustees of the South African Public Library such books and manuscripts in the collection of books and manuscripts in its possession known as the Grey Collection as relate to South Africa and its people, and may forward the same to the said Board:

    Provided that no such transfer shall be effected until the Council has caused such books and manuscripts to be examined, and has made a report thereon to the Minister of Internal Affairs, and has received his approval of the transfer.

    (2) The Auckland City Council may receive on behalf of the New Zealand Government from the Board of Trustees of the South African Public Library in exchange for the books and manuscripts so transferred any books and manuscripts which, having formerly belonged to the late Sir George Grey, are now deposited in the South African Public Library, and which relate to the Maoris of New Zealand and to Polynesia. Any books and manuscripts so received in exchange shall thereupon be held by the Auckland City Council in trust for the people of New Zealand, and shall be deposited with the said Grey Collection.
