Whangarei Borough Leasing Empowering Act 1922

An Act to enable the Whangarei Borough Council to lease Part of Kensington Park to the Whangarei Racing Club (Incorporated).

  • Preamble

    WHEREAS Kensington Park, being Parts of Allotments 1 and 2 of the Parish of Whangarei, County of Marsden, is vested in the Mayor, Councillors, and Burgesses of the Borough of Whangarei (hereinafter termed the borough) for the use, enjoyment, and recreation of the inhabitants of the Borough of Whangarei: And whereas the said park contains the most suitable land available as a racecourse for the use of the inhabitants of the Borough of Whangarei: And whereas the borough proposes to lease certain parts of Kensington Park to the Whangarei Racing Club (Incorporated) for the purposes of racing: And whereas the Whangarei Racing Club (Incorporated) proposes to improve Kensington Park by erecting buildings and other permanent improvements thereon: And whereas for the purposes aforesaid it is desirable to give the borough full powers of leasing certain parts of the said park to the Whangarei Racing Club (Incorporated):

BE IT THEREFORE ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title
  • This Act may be cited as the Whangarei Borough Leasing Empowering Act, 1922.

2 Leasing-power to Whangarei Racing Club (Incorporated)
  • The Whangarei Borough Council is hereby empowered to lease such parts of Kensington Park aforesaid as it may consider fit to the Whangarei Racing Club (Incorporated), its successors and assigns, for the purposes of racing.

3 Commencement and term of lease
  • The lease shall take effect within a period of six months from the date of the passing of this Act, and shall be for a term not exceeding thirty-one years:

    Provided that no racing-track shall at any time be used for the purpose of training or exercising horses later than nine o'clock in the forenoon, except by express permission of the Whangarei Borough Council:

    Provided also that nothing in such lease shall so operate as to prevent the public from having, on any days on which such land is not being used for the purpose of holding race meetings thereon, such right of free access thereto and to any buildings thereon as would have been enjoyed by the public had the lease not been granted:

    Provided further that the number of days on which such land may be used for the purpose of holding race meetings shall not at any time exceed six days in any one year.
