Whangarei Borough Empowering Act 1928

An Act to enable the Whangarei Borough Council to borrow Moneys for the Construction and Formation of Private Streets within the Borough.

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title
  • This Act may be cited as the Whangarei Borough Empowering Act 1928.

2 Interpretation
  • In this Act the words private street have the meaning attached thereto as defined in The Municipal Corporations Act 1920.

3 Empowering Council to borrow money to construct private streets
  • The Whangarei Borough Council may from time to time borrow under the authority of The Local Bodies' Loans Act 1926, any moneys it may deem necessary for the formation and construction (including footpaths, kerbing, and channelling, if and where deemed necessary) of all or any of the private streets mentioned and described in the Schedule hereto, the same all being within the boundaries of the Borough of Whangarei.

4 Special order declaring public street
  • Upon the formation and construction as aforesaid of any or all the said private streets such private street or private streets shall by special order of the Council be declared to be a public street or public streets.

5 Separate rating-areas for recovery of half interest charges
  • The Whangarei Borough Council may declare and define separate areas in which are included all or any of the private streets referred to in the Schedule hereto, and may make and levy annually over such separate areas a separate rate or rates of sufficient amount to pay half the interest and sinking-fund charges on the loan or raised under the authority of this Act for the formation and construction of the private streets within the said separate areas. While such separate rates are being made and levied the amount to be collected of the special rate made and levied over the whole Borough in respect of the loan or loans shall be reduced accordingly.
