Wellington City Empowering Act 1928

An Act to vest Portion of the Bolton Street Cemetery in the Mayor, Councillors, and Citizens of the City of Wellington for the Purposes of a Street.

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title
  • This Act may be cited as the Wellington City Empowering Act 1928.

2 Definitions
  • In this Act—

    Corporation means the Corporation of the Mayor, Councillors, and Citizens of the City of Wellington.

    Council means the Wellington City Council.

3 Vesting of portion of Bolton Street Cemetery and Anderson Park in the Wellington City Corporation for purposes of a public street
  • The lands described in the Schedule hereto are hereby vested in the Corporation for the purposes of a street, freed and discharged from all rights or easements of burial.

4 Reinterment of human remains disturbed by street operations
  • (1) Wherever the operations of the Council necessary to construct a street or street works on the lands described in the Schedule hereto shall interfere with or disturb any human remains on the said lands such remains shall be reinterred in a place approved by the Minister of Health and subject to such directions as he shall in his absolute discretion think fit to give to the Council in the matter.

    (2) All monuments and gravestones situate on the lands described in the Schedule hereto shall be re-erected in a position approved by the Minister of Health or otherwise disposed of to his satisfaction.


Schedule

THOSE pieces of land situate in the City of Wellington being as follows:—

  • All those pieces of land containing respectively 11.29 and 3.85 perches, be the same a little more or less, being part of the Bolton Street Cemetery, as the same is delineated on the plan prepared by Frederic Charles Basire dated the 3rd September, 1928, and thereon coloured yellow.

  • All that piece of land containing 0.85 perch, be the same a little more or less, being portion of the Bolton Street Cemetery, and being part of the land which was originally Jewish Cemetery, as the same is delineated on the said plan, and thereon coloured neutral.

  • All that piece of land containing 2 roods 34.59 perches, be the same a little more or less, being portion of Anderson Park and portions of the land which was originally known as Church of England Cemetery, Number 3, and Public Cemetery, Number 5, as the same is delineated on the said plan, and thereon coloured red.
