Timaru Borough Empowering Act 1929

An Act empowering the Timaru Borough Council to expend Moneys on the Maintenance and Repair of certain Streets not vested in the Corporation of the Borough.

  • Preamble

    WHEREAS the Timaru Harbour Board (hereinafter referred to as the Board) is the owner of certain freehold lands situated within the boundaries of the Borough of Timaru, being land vested in the Board by The Timaru Harbour Board Act 1876 Amendment Act 1881, particulars of which are set out in the Schedule hereto: And whereas the said lands have from time to time been subdivided by the Board for the purpose of leasing the same: And whereas, in order to provide access for past, present, and future lessees to the land so leased as aforesaid, the Board has from time to time constructed certain streets through and over the said lands (but the said streets still remain vested in the Board), and the Board may in the future construct other streets for the same purpose through and over the said lands or other lands hereafter reclaimed adjacent thereto: And whereas it has been found desirable that the said streets and such other streets should remain vested in the Board, but that the Timaru Borough Council (hereinafter referred to as the Council) shall have power to expend moneys on the repair and maintenance of the said streets and such other streets as if the same were vested in the Corporation of the Borough of Timaru (hereinafter referred to as the Corporation):

BE IT THEREFORE ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title
  • This Act may be cited as the Timaru Borough Empowering Act 1929.

2 Timaru Borough Council empowered to maintain and repair certain streets not vested in the Corporation
  • It shall be lawful for the Council to expend moneys on the repair and maintenance of streets already constructed or to be constructed by the Board through and over the lands described in the Schedule hereto, and any lands adjacent thereto hereafter reclaimed by action of the sea and vested in the Board, in the same manner and to the same extent as if the said streets were vested in the Corporation.


Schedule

COMMENCING at the intersection of mean high-water mark and the southern side of Eastern Extension Mole; thence in a westerly direction along the south side of the said mole to the east end of Wharf Street; thence north-westerly to a point on the northern side of Wharf Street and westerly along the said north side of Wharf Street to the eastern boundary of the railway land a distance of 1,400 feet; thence generally in a southerly direction along the eastern boundary of the railway land to the south side of Queen Street; thence in a south-easterly direction along the boundary of the railway land and the north side of South Street for a distance of 1,000 feet from Queen Street; thence in a north-easterly direction to mean high-water mark; thence in a northerly direction along the said high-water mark to the commencing-point.
