Christchurch City Reserves Amendment Act 1929

An Act to amend the Christchurch City Reserves Act 1877.

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title
  • This Act may be cited as the Christchurch City Reserves Amendment Act 1929, and shall be read together with and deemed part of the Christchurch City Reserves Act 1877 (hereinafter referred to as the principal Act).

2 Change of purpose of land vested in City by Schedule 4 of principal Act
  • The trusts imposed by the principal Act on the land described in Schedule 1 hereto, being the land vested in the Corporation of the City of Christchurch by section five of the principal Act, are hereby removed, and the land is hereby declared to be vested in the said Corporation in trust for the recreation and enjoyment of the people of Christchurch.

3 Temporary use of land for Plunket Society purposes
  • (1) Notwithstanding anything to the contrary in the Public Reserves, Domains, and National Parks Act 1928, or any other Act, the Christchurch City Council may grant to the Christchurch Branch of the Royal New Zealand Society for the Health of Women and Children (commonly known as the Plunket Society) a license to use for the general purposes of the Society the whole or part of any building standing at the commencement of this Act on that portion of the said land described in Schedule 2 hereto for such period or periods as the Council may determine and upon such terms and conditions as may be agreed upon, and the Council may make such alterations to the existing building or buildings as may be necessary for the purpose.

    (2) If no license is granted to the society within twelve months after the passing of this Act, or if the society ceases to occupy any building for three months, or upon the termination of the license, the Council shall demolish the building or buildings, and the land shall revert to the purpose for which it is declared to be vested by this Act in the Corporation.

    (3) Section five of the principal Act and Schedule 4 thereto are hereby repealed.

    Subsection (1) was amended, as from 2 October 1946, by omitting the words for a period not exceeding fifteen years from the passing of this Act and substituting the words for such period or periods as the Council may determine pursuant to s 11 Christchurch City Empowering Act (No 2) 1946 (1946 No 9(L)).

4 Council may borrow $6,000 for certain purposes
  • The Christchurch City Council may borrow by way of special loan under the Local Bodies Loans Act 1926, but without taking the steps described in sections nine to thirteen of that Act, a sum or sums not exceeding six thousand dollars, and may expend the proceeds of such loan or loans for the purpose of altering any existing building or buildings as authorized by the last preceding section.

    The expressions $6,000, and six thousand dollars, were substituted, as from 10 July 1967, for the expressions £3,000, and three thousand pounds pursuant to section 7(1) Decimal Currency Act 1964 (1964 No 27).


Schedule 1

ALL that parcel of land extending from Colombo Street to Manchester Street, bounded on the south and south-west by Oxford Terrace and on the north and north-east by the River Avon.

Schedule 2

ALL that piece or parcel of land, containing by admeasurement 261/2 perches, being portion of the reserve as described in Schedule 1 to this Act: commencing at the south-east corner of the land comprised in certificate of title, Volume 279, folio 200; thence in a north-easterly direction along the north side of Chester Street, bearing 89° 49′ 5″, for a distance of 135 links; thence north-westerly along a line bearing 359° 49′ 5″, for a distance of 50 links; thence in a north-westerly direction along a line bearing 331° 16′ for a distance of 100.9 links; thence in a south-westerly direction along a line bearing 269° 49′ 5″ for a distance of 87 links; thence in a south-easterly direction along the eastern boundary of the land comprised in the said certificate of title, Volume 279, folio 200, being along a line bearing 179° 49′ 5″ for a distance of 138.65 links, back to the commencing-point: be all the aforesaid dimensions a little more or less.
