An Act to provide for the Management of Portion of Motuihi Island as a Public Domain by the Auckland City Council, and to confer certain Powers on the said Council relating to Workers' Dwellings.

  • Preamble

    WHEREAS portion of Motuihi Island, in the Hauraki Gulf, has been set aside as a public domain, and the Auckland City Council has been appointed the Domain Board in respect thereof, under the name of the Motuihi Island Domain Board: And whereas it is expedient that the said Council should be granted certain additional powers in relation to the said domain: And whereas the Auckland City Council some time since raised certain loans for the purpose of erecting workers' dwellings on land owned by it in the City of Auckland: And whereas such dwellings were erected and have been sold by the Council to workers, and the Council holds mortgages over the said dwellings: And whereas various defects now exist in the said dwellings, and the owners are unable to repair or make good the same, and the dwellings are depreciating thereby: And whereas the Council has in hand certain moneys being the unexpended portion of the loans above mentioned: And whereas it is expedient to authorize the Council to expend moneys in repairing and improving the said workers' homes or some of them:

1 Short Title
  • This Act may be cited as the Auckland City Council and Motuihi Island Domain Board Empowering Act 1930.

2 Additional powers given to Domain Board
  • The Auckland Council (hereinafter called the Council) as the Motuihi Island Domain Board shall have and may exercise in relation to the Motuihi Island Domain in addition to all the powers and authorities vested in it by The Reserves Act 1977, or by any other Act, the following powers and authorities:—

    • (a) The right to make and enforce reasonable charges for persons landing on or using the said domain, or the foreshore thereof, or any part or parts thereof, including additional or special charges for the use of or admission to any building, structure, or enclosure in the said domain.

    • (b) All such rights, powers, and authorities as the Council has in relation to lands acquired by it under section 302 of the Municipal Corporations Act 1920, for the purpose of the enjoyment or recreation of the public.

    • (c) The right at all times hereafter to use, control, and maintain the wharf abutting on the said domain and to renew or replace the same as if the Council had obtained a license for such purpose under section 156 of the Harbours Act 1923, but subject to such rights and privileges in favour of His Majesty the King for the benefit of the quarantine station on the said island as may be agreed on.

    • (d) The control of the whole of the foreshore of the said domain from mean high-water mark down to low-water mark of spring tides and in relation thereto, the Council shall have and may exercise all rights, powers, and authorities which are by section 158 of the Harbours Act 1923, vested in or conferred upon a local authority to which control of a foreshore is granted under that section.

    • (e) The right to close the domain and the foreshore thereof and to prevent any person from entering or landing thereon during any period when a vessel is at the quarantine station on Motuihi Island or when on account of disease among stock at the said quarantine station such closing is advisable, or when His Majesty the King in the event of any national or other emergency requires the domain for defence, internment, or other purposes.

3 Domain Board and Crown may enter into agreements
  • The Council as the Motuihi Island Domain Board and the Minister of Lands on behalf of the Crown are hereby authorized and empowered to enter into and carry out such agreements and arrangements as may be found necessary or expedient relating to the water-supply on the said island, the use and upkeep of the wharf, and other matters arising in consequence of portion of the said island becoming a domain.

4 Council may repair and improve workers' dwellings
  • The Council is hereby authorized to expend such sums of money as it thinks advisable in or towards the repair and improvement of the workers' dwellings heretofore erected in Auckland, notwithstanding that the same may have been sold by the Council, and the Council may use for such purpose any funds in its hands representing the unexpended balance of any loan heretofore raised for the erection of workers' dwellings.
