An Act to enable the Palmerston North City Council to have Control of all Drains and Watercourses within the City of Palmerston North.
WHEREAS it is expedient that the Palmerston North City Council shall have all the powers of a Drainage Board in respect of all watercourses and drains within the City of Palmerston North, notwithstanding that such city is within the Palmerston North River District:
BE IT THEREFORE ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
This Act may be cited as the Palmerston North City Council Empowering Act 1938.
(1) The Palmerston North City Council shall have and may, in regard to the cleansing, repairing, or otherwise maintaining of watercourses or drains within the City of Palmerston North, exercise the powers exercisable by Drainage Boards under the provisions of Part 1 of the Land Drainage Act 1908.
(2) Nothing in this section shall be construed to authorize the Palmerston North City Council to exercise any jurisdiction in respect of the Manawatu River.
From and after the passing of this Act the Palmerston North River Board shall cease to have any jurisdiction within the boundaries of the City of Palmerston North except to such extent as may be necessary to enable it to have full and complete control and jurisdiction in respect of the Manawatu River.
