(1) There is hereby established a Board constituted as hereinafter provided.
(2) The Board shall be a body corporate under the name of the Hawke's Bay Crematorium Board, with perpetual succession and a common seal, and shall be capable of holding and dealing with real and personal property and of doing and suffering all that bodies corporate may lawfully do and suffer.
(3) The Board shall be deemed to be a local authority for the purposes of the Public Works Act 1981, the Income Tax Act 2007, , the Local Authorities Loans Act 1956, .

In subsection (3) the reference to the Public Works Act 1981 was substituted, as from 1 February 1982, for the repealed Public Works Act 1928 pursuant to section 248(1) Public Works Act 1981 (1981 No 35).
The reference to the Income Tax Act 1976 was substituted, as from the 1 April 1977, for a reference to the Income Tax Act 1923 pursuant to section 436 of the Income Tax Act 1976 (1976 No 65). That Act was in turn substituted, as from 1 April 1995, by the Income Tax Act 1994 (1994 No 164).
The Local Authorities Loans Act 1956 repealed, as from 1 April 1957, the reference to the Local Bodies Finance Act 1921-22 pursuant to section 135(1) of that Act Local Authorities Loans Act 1956 (1956 No 63).
The Local Authorities Loans Act 1956 was substituted, as from 1 April 1957, for a reference to the Government Loan Board Act 1926 pursuant to section 135(1) of the Local Authorities Loans Act 1956 (1956 No 63).
The reference to the Local Authorities (Members' Contracts) Act 1934 was repealed, as from 29 September 1954, by section 7(3) of the Local Authorities (Members' Contracts) Act 1954 (1954 No 49).
Subsection (3) was amended, as from 1 April 2005, by section YA 2 Income Tax Act 2004 (2004 No 35) by substituting the words “Income Tax Act 2004”
for the words “Income Tax Act 1994”
