An Act to amend the Christchurch Hospital Act 1887.

  • Preamble

    WHEREAS by section three of the Christchurch Hospital Act 1887, the lands described in Schedules 3 and 4 to the said Act were vested in the North Canterbury Hospital Board in trust for the purposes of a kitchen-garden and of pleasure-gardens and recreation-grounds respectively for the use of the inmates of the Christchurch Hospital, and for no other purpose: And whereas the said Board desires to remodel its hospital buildings, and for such purpose it is desired to use part of the lands described in Schedule 4 to the Christchurch Hospital Act 1887, and it is therefore necessary to provide for the release of portion of those lands from the trusts of the said Act in manner hereinafter set out: And whereas the creek which forms the north boundary of the land described in Schedule 1 to the Christchurch Hospital Act 1887, and the north-east boundary of the land described in Schedule 2 to the said Act, and the south boundary of the land described in Schedule 3 to the said Act, and the south boundary of the land described in Schedule 4 to the said Act no longer exists, and the said Board desires to acquire part of the land which formerly formed the bed of the said creek for an estate in fee-simple for the purposes of the Christchurch Hospital:

BE IT THEREFORE ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title
  • This Act may be cited as the Christchurch Hospital Amendment Act 1944, and shall be read together with and deemed part of the Christchurch Hospital Act 1887 (hereinafter referred to as the principal Act).

2 Provision for partial cancellation of trust
  • [Repealed]

    Sections 2 and 3 were repealed, as from 5 December 1979, by section 5 Christchurch Hospital Amendment Act 1979 (1979 No 12(L)).

3 Preservation of balance of trust
  • [Repealed]

    Sections 2 and 3 were repealed, as from 5 December 1979, by section 5 Christchurch Hospital Amendment Act 1979 (1979 No 12(L)). See also section 2 of that Act as to provision for partial cancellation of trust.

4 Vesting of creek-bed
  • The land described in the Schedule hereto, being the dry bed of the hereinbefore-mentioned creek, is hereby vested in the North Canterbury Hospital Board for an estate in fee-simple to be held by the said Board for the purposes of the Christchurch Hospital.

5 Correction of titles
  • The District Land Registrar of the Land Registration District of Canterbury is hereby directed and empowered to call in and endorse such titles, to make such entries in the Register, and generally to do all such things as may be necessary to give effect to the provisions of this Act and of any Proclamation issued under section two of this Act.


Schedule

ALL that area in the Canterbury Land District, containing by admeasurement 24 perches, more or less, and being part of Reserve 24, situated in the City of Christchurch, and bounded as follows: towards the south generally by other part of Reserve 24 defined as the souther edge of the dry bed of a creek forming the northern boundary of the Christchurch Hospital site as described in Schedule 1 and 2 to the Christchurch Hospital Act 1887, a distance of approximately 1440.0 links; towards the north-west by other part of Reserve 24 as defined by a right line bearing 13° 52′, distance 7.0 links; towards the north generally by other part of Reserve 24 defined as the northern edge of the dry bed of a creek forming the northern boundary of the Christchurch Hospital Site as described in Schedules 1 and 2 to the Hospitals Act 1887, aforesaid, distances of approximately 272.0 links, 247,0 links, and 912.0 links, to the River Avon. As the same is more particularly delineated on the plan marked L and S 1/562c, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.
