Taranaki Harbours Board Empowering Act 1965

An Act to authorise the Taranaki Harbours Board to raise a loan

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:

1 Short Title
  • This Act may be cited as the Taranaki Harbours Board Empowering Act 1965.

2 Special Act
  • This Act shall for all purposes be deemed to be a special Act within the meaning of the Harbours Act 1950.

3 Interpretation
  • In this Act, unless the context otherwise requires, Board means the Taranaki Harbours Board.

4 Power to borrow and works authorised
  • (1) It shall be lawful for the Board from time to time as it may require to borrow, in addition to the sums authorised by any previous Acts, but subject to the provisions of the Harbours Act 1950 and the Local Authorities Loans Act 1956, such sum or sums not exceeding in the whole the sum of three million eight hundred and forty eight thousand dollars.

    (2) The money so borrowed shall be applied by the Board in the construction and carrying out, subject to the provisions of the Harbours Act 1950, of the harbour works and for the other purpose specified in the Schedule to this Act.

    (3) The works specified in the said Schedule shall, for the purposes of the Harbours Act 1950, or any other Act, be deemed to be harbour works.

    (4) The Board is hereby authorised, subject to the Harbours Act 1950, to construct and carry out such works.

    The words three million eight hundred and forty eight thousand dollars in subsection (1) were substituted, as from 10 July 1967, for the words one million nine hundred and twenty-four thousand pounds pursuant to section 7(1) Decimal Currency Act 1964 (1964 No 27).

5 Authority to reclaim land
  • The Board is hereby authorised, notwithstanding anything in section 175 of the Harbours Act 1950, but subject to the provisions of sections 178 to 182 of that Act, to reclaim the following areas: All those areas in the Taranaki Land District, situated in Block IV, Paritutu Survey District, containing 13 acres and 17 acres 2 roods 20 perches, more or less, respectively, being part of Harbour Reserves A and L and part New Plymouth Roadstead, and being part of the land comprised in certificate of title, Volume 102, folio 148, Taranaki Registry, as the same is shown bordered red on plan marked MD 12101, deposited in the office of the Marine Department at Wellington.

6 Refund of money expended
  • The Board is hereby authorised to refund to its Harbour Fund Account from money borrowed under the authority of this Act the amount of any money expended not exceeding forty thousand dollars, whether before the passing of this Act or within nine months thereafter, in the construction and carrying out of the harbour works set out in the Schedule to this Act, and any amount so refunded shall be deemed to have been applied or expended for that purpose.

    The words forty thousand dollars in subsection (1) were substituted, as from 10 July 1967, for the words twenty thousand pounds pursuant to section 7(1) Decimal Currency Act 1964 (1964 No 27).

7 Prior securities not affected
  • Nothing in this Act or in any debentures or stock issued in pursuance thereof shall affect or prejudice the rights of the holders of any debentures or stock heretofore executed or issued by the Board pursuant to the provisions of any other Act.

8 Investment by trustees
  • [Repealed]

    This section was repealed, as from 1 October 1988, by section 16(1) Trustee Amendment Act 1988 (1988 No 111).

Section 4

Capital dredging, reclamation, and filling of land and the sea bed, site clearance, construction of containing walls, bunds, and drainage works, design, supervision, preliminary fees, and expenses and loan raising expenses.
