An Act to revest certain land originally acquired for the purpose of widening Lincoln Road, Henderson

Be it enacted by the Parliament of New Zealand as follows:

1 Short Title
  • This Act may be cited as the Waitemata City Council (Lincoln Road) Revesting Act 1987.

2 Closing and vesting of road in Covic Motors Limited
  • (1) The road described in clause 1 of Schedule 1 to this Act is hereby stopped and vested in fee simple in Covic Motors Limited.

    (2) The said piece of land is hereby amalgamated with the land described in clause 2 of the said Schedule 1; and the District Land Registrar for the North Auckland Land Registration District is hereby authorised and directed to amend the certificate of title for the land described in the said clause 2 accordingly, without fee.

    (3) On such amendment the land described in the said clause 1 shall become subject to all encumbrances, easements, and other interests which are noted on the said certificate of title and shall take the benefit of all appurtenances so noted.

3 Closing and vesting of road in G E and Y P Vodanovich
  • (1) The road described in clause 1 of Schedule 2 to this Act is hereby stopped and vested in fee simple in Gayo Edward Vodanovich of Henderson, orchardist, and Yvonne Pauline Vodanovich, his wife.

    (2) The said piece of land is hereby amalgamated with the land described in clause 2 of the said Schedule 2; and the District Land Registrar for the North Auckland Land Registration District is hereby authorised and directed to amend the certificate of title for the land described in the said clause 2 accordingly, without fee.

    (3) On such amendment the land described in the said clause 1 shall—

    • (a) become subject to all encumbrances, easements, and other interests which are noted on the said certificate of title and shall take the benefit of all appurtenances so noted; and

    • (b) notwithstanding anything in the Joint Family Homes Act 1964, be deemed to have been settled as a joint family home on Gayo Edward Vodanovich of Henderson, orchardist, and Yvonne Pauline Vodanovich, his wife.

4 Restriction on transfer, etc
  • (1) The land described in clause 1 of Schedule 1 to this Act and the land described in clause 2 of that Schedule shall not be disposed of separately, and a separate certificate of title for either of those pieces of land shall not be issued, except pursuant to an approval under Part 20 of the Local Government Act 1974.

    (2) The land described in clause 1 of Schedule 2 to this Act and the land described in clause 2 of that Schedule shall not be disposed of separately, and a separate certificate of title for either of those pieces of land shall not be issued, except pursuant to an approval under Part 20 of the Local Government Act 1974.

    (3) The District Land Registrar for the North Auckland Land Registration District shall without fee note on the certificates of title for the land affected by this section the fact that the land is so affected.

ss 2, 4(1), (3)

  • 1ALL that piece of road containing 493 m2, situated in Block XIV, Waitemata Survey District, adjoining Lot 1, DP 78440, Lot 1, DP 57618, and Lot 3, DP 1263, as shown marked A on SO plan 52488 lodged in the office of the Chief Surveyor at Auckland.

  • 2ALL that piece of land containing 2949 m2, more or less, being Lot 1, DP 57618 and being part Allotment 6, Parish of Waipareira, and being all the land comprised and described in certificate of title, Volume 11C, folio 1130, North Auckland Registry.


Schedule 2

ss 3, 4(2), (3)

  • 1ALL that piece of road containing 79 m2, situated in Block XIV, Waitemata Survey District, adjoining Lot 1, DP 66415, part allotment 6, Parish of Waipareira (CT 22C/1210), and part Allotment 6, Parish of Waipareira (CT 625/158), as shown marked A on SO plan 60244 lodged in the office of the Chief Surveyor at Auckland.

  • 2ALL that piece of land containing 839 m2, more or less, being Lot 1, DP 66415 and being part Allotment 6, Parish of Waipareira, and being all the land comprised and described in certificate of title, Volume 22C, folio 1209, North Auckland Registry.
