1 Title

This Act is the Gisborne District Council (Alfred Cox Park) Validation Act 2006.

2 Commencement

This Act comes into force on the day after the date on which it receives the Royal assent.

3 Interpretation

In this Act, unless the context otherwise requires,—

Council means the Gisborne District Council

Alfred Cox Park means the land described in the Schedule.

4 Certain uses of Alfred Cox Park validated

(1)

The use of Alfred Cox Park, and the actions of the Council in permitting the use of Alfred Cox Park, as a site for a flea market and a visitor information centre are deemed to be and to have always been lawful.

(2)

Subsection (1) overrides—

(a)
(b)

the deed of trust, dated 16 May 1944, between Alfred James Cox and the Mayor, Councillors, and Burgesses of the Borough of Gisborne.

5 Application of Reserves Act 1977

(1)

The Reserves Act 1977 applies to Alfred Cox Park, subject to this Act.

(2)

This section applies to avoid doubt.

All those pieces of land containing 2.0851 hectares more or less being lots 106-110 on Deposited Plan 1357 lot 1 on Deposited Plan 2749 and lot 1 on Deposited Plan 3627 being all of the land comprised in record of title volume 2A folio 485 Gisborne Registry.
