Saint Andrew's Church (Wellington) Trustees Empowering Act 1907

An Act to vest the Lands and Property now held by the Trustees of Saint Andrew's Church under the Saint Andrew's Church (Wellington) Trustees Incorporation Act 1873, in the Presbyterian Church Property Trustees as incorporated by the Presbyterian Church Property Act 1885, and to make Further Provisions in relation to such Land and Property.

  • Preamble

    WHEREAS by the Saint Andrew's Church (Wellington) Trustees Incorporation Act 1873, certain lands and properties were vested in the Trustees of Saint Andrew's Church, Wellington, in trust for Saint Andrew's Church, Wellington, in connection with the Established Church of Scotland: And whereas, in the year eighteen hundred and seventy-four, with the sanction of the Colonial Committee of the Church of Scotland, an incorporating union was entered into between Saint Andrew's Church, Wellington, and the Presbyterian Church of New Zealand, whereby Saint Andrew's Church, Wellington, ceased to be ecclesiastically connected with the Established Church of Scotland, and became ecclesiastically connected with the Presbyterian Church of New Zealand, which incorporating union was approved by the General Assembly of the Established Church of Scotland in the year eighteen hundred and seventy-five: And whereas it is desirable that the lands and properties vested in the said Trustees of Saint Andrew's Church, Wellington, at the date of the passing of this Act should vest in the Presbyterian Church Property Trustees incorporated by the Presbyterian Church Property Act 1885:

BE IT THEREFORE ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title

  • This Act may be cited as the Saint Andrew's Church (Wellington) Trustees Empowering Act 1907.

2 Property to vest in the Presbyterian Church Property Trustees

  • From and after the passing of this Act—

    • (a) The land described in Schedule 1 hereto, and the church and other buildings thereon erected, shall, without any assignment, transfer, conveyance, or other assurance whatsoever, vest in and be held by the Presbyterian Church Property Trustees as incorporated by the Presbyterian Church Property Act 1885 (hereinafter called the said Act), upon trust to permit the same to be for ever appropriated and used as and for the congregation of Saint Andrew's Church, Wellington, in connection with the Presbyterian Church of New Zealand:

    • (b) The land described in Schedule 2 hereto, and all other property, funds, and moneys belonging to Saint Andrew's Church aforesaid now in the possession or under the control of the Trustees of the said Church, shall, without any assignment, transfer, conveyance, or other assurance whatsoever, vest in and be held by the Presbyterian Church Property Trustees as incorporated by the said Act, upon trust to apply the net rents, income, and interest thereof in or towards the support of the Minister and the maintenance of religious worship in Saint Andrew's Church aforesaid.

3 Provisions of the Presbyterian Church Property Act 1885, to apply

  • Subject to the trusts declared in section two hereof, all the provisions contained in the said Act shall apply to the lands, buildings, and other property, funds, and moneys vested by the said section in the Presbyterian Church Property Trustees, and in order to give effect to this Act it is hereby declared that the last paragraph of subsection two of section fifteen of the said Act is hereby modified so far as the same relates to the land and property dealt with by this Act.

4 Repeal

  • The Saint Andrew's Church (Wellington) Trustees Incorporation Act 1873, and the Saint Andrew's Church (Wellington) Trustees Act 1873 Amendment Act 1877, are hereby repealed.

Schedule 1

ALL that piece of land situated in the City of Wellington, containing 291/2 perches, more or less, being portion of section numbered four hundred and seventy-two (472) on the plan of the said city: commencing at a point 1681/4 links south from Bolton Street; thence south 264° 50′ west, 2051/4 links; thence south 174° 50′ east, 873/4 links; thence north 85° 40′ east, 2051/4 links; thence north 354° 50′ west, 903/4 links, to the point of commencement: and being the whole of the land described in certificate of title, Vol vi, folio 83.

All that piece of land situated in the City of Wellington, containing 16 perches, more or less: bounded towards the north, 135 ft 5 in, by other part of the undermentioned section; towards the east, 32 ft, by Wellington Terrace; towards the south, 135 ft 3 in, and towards the west, 32 ft, respectively, by other parts of the said section: the northern boundary whereof runs parallel with and is distant from Bolton Street 79 ft: which said piece of land is part of the section marked “472”, and being the whole of the land described in certificate of title, Vol vii, folio 169.

Schedule 2

ALL that parcel of land situated in the Provincial District of Wellington, in the Colony of New Zealand, containing by admeasurement 256 acres 2 roods 18 perches, more or less, being the section numbered 27 and part of 28 on the plan of the Turakina District: bounded towards the north by Section No 34, 1718 links, and by Sections Nos 26 and 28, 1958 links; towards the east by other part of Section No 28, 6338 links, and by Section No 25, 6250 links; towards the south by Section No 31, 1100 links, and by the Makirikiri Stream; and towards the west by Sections Nos 29, 30, and 31, 5900 links, and by Sections Nos 31 and 32, 5979 links; excepting always the public roads, 100 links wide, running through the said sections; and subject to a right of road, 100 links wide, reserved through the same.

All that piece of land situated in the City of Wellington, containing 211/2 perches, more or less: bounded towards the north, 65 ft, by other part of Section No 547; towards the east, 90 ft, by Section No 548; towards the south, 65 ft, by Hill Street; and towards the west, 90 ft, by the right-of-way hereinafter mentioned: together with a right-of-way for the registered proprietor for the time being of the land above described, his agents, servants, and workmen, over that parcel of land 10 ft, in width and 90 ft in length, other part of said Section No 547, and running from Hill Street along the western boundary of the land above described, which said piece of land is part of Section No 547: and being all the land described in certificate of title, Vol xv, folio 86.

All that piece of land, containing 1 acre and 1 perch, more or less, being Section No 596 in the public map of the Town of Halcombe, deposited in the Land Registry Office at Wellington, No 42, originally granted the 20th day of August, 1877, to the Emigrant and Colonists Aid Corporation (Limited), and being all the land described in Vol xxvii, folio 281.
