WHEREAS the lands described in the Schedule hereto were conveyed by deed dated the fifth day of October, eighteen hundred and sixty-five, registered No 15223, by the Superintendent of the Province of Canterbury to William Wilson, John Anderson, James Johnston, the Rev Charles Frazer, and Robert Wilkin upon trust as a site for a church and schools and for the residence of a clergyman and schoolmaster in connection with the Free Church of Scotland, with a proviso that if the said lands were not occupied for the purpose aforesaid within the time specified, or should at any time cease to be so occupied, the same should revert to the Superintendent: And whereas the said lands have since become vested in the Presbyterian Church Property Trustees constituted under the Presbyterian Church Property Act 1885: And whereas it is desirable that the said lands should be vested in the Presbyterian Church Property Trustees free from any restriction or reservation:
