Presbyterian Church Reserves (Canterbury) Act 1926

An Act to provide for the Vesting in the Presbyterian Church Property Trustees constituted under the Provisions of the Presbyterian Church Property Act 1885, of certain Lands, being Part of the Town Reserves of Christchurch, freed from certain Restrictions or Reservations to which such Lands are now subject.

  • Preamble

    WHEREAS the lands described in the Schedule hereto were conveyed by deed dated the fifth day of October, eighteen hundred and sixty-five, registered No 15223, by the Superintendent of the Province of Canterbury to William Wilson, John Anderson, James Johnston, the Rev Charles Frazer, and Robert Wilkin upon trust as a site for a church and schools and for the residence of a clergyman and schoolmaster in connection with the Free Church of Scotland, with a proviso that if the said lands were not occupied for the purpose aforesaid within the time specified, or should at any time cease to be so occupied, the same should revert to the Superintendent: And whereas the said lands have since become vested in the Presbyterian Church Property Trustees constituted under the Presbyterian Church Property Act 1885: And whereas it is desirable that the said lands should be vested in the Presbyterian Church Property Trustees free from any restriction or reservation:

BE IT THEREFORE ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title

  • The Short Title of this Act is the Presbyterian Church Reserves (Canterbury) Act 1926.

2 Lands vested in the Presbyterian Church Property Trustees without liability to revert to His Most Gracious Majesty the King

  • The Presbyterian Church Property Trustees constituted under the Presbyterian Church Property Act 1885, shall hold the lands set out and described in the Schedule hereto free from the proviso contained in the deed of the fifth day of October, eighteen hundred and sixty-five, and the liability of the said lands to revert to His Most Gracious Majesty the King as in the proviso to the said deed mentioned or indicated:

    Provided, nevertheless, that in all other respects the said lands shall be held by the Presbyterian Church Property Trustees with the powers and subject to the provisions of the Presbyterian Church Property Act 1885, and the amendments thereof.

THREE roods and twenty perches, bounded on the north-west by Hagley Avenue, on the south by Tuam Street, and on the east by Antigua Street, forming a triangular block.
No 2.
Two acres and twenty perches, bounded on the north by Tuam Street, on the east by Antigua Street, on the north-west by Hagley Avenue, and on the south and south-west by Lot Number 1 of the Christchurch Town Reserves.
