An Ordinance intituled the Invercargill Athenaeum Reserves Management Ordinance 1873

  • Preamble

    [Repealed]

    The Preamble was repealed by section 2 Statutes Repeal Act 1907.

1 Short Title
  • This Ordinance may be cited and referred to as the Invercargill Athenaeum Reserves Management Ordinance 1873.

2 Invercargill Athenaeum Ordinance 1871
  • The parcels of land described in the Schedule hereto shall be transferred to and vested in and held by the Invercargill Athenaeum in trust for the purposes of the said Institution subject to the powers, provisions, and conditions herein expressed and declared.

    Section 2 was amended by section 2 Statutes Repeal Act 1907 by omitting the word said.

4 Power to lease lands
  • It shall be lawful for the Committee of Management of the Invercargill Athenaeum corporation by deed under their corporate seal to lease from time to time at such rent and on such conditions as they may think reasonable the whole or any part of the said parcels of land specified in the said Schedule hereto not required for the purposes of the said Institution for any term of years not exceeding 29 years at any one time.

5 Application of money
  • All money received by the Invercargill Athenaeum corporation for the rents, issues and profits of the said parcels of land shall after deducting therefrom all necessary expenses incurred in the management thereof be applied in and towards the purposes of the said Institution as the Committee of Management may from time to time determine.

6 Committee to keep accounts and furnish balance sheets to be audited
  • The Committee of Management shall keep accurate accounts of all sums of money received to rents, issues and profits on account of the said parcels of land and of all costs, charges, expenses and disbursements in connection with the management and maintenance thereof and within one week after the day of the annual meeting of the said Institution a copy of the balance sheet showing the receipts and disbursements of the Committee in duplicate shall be fowarded to the Superintendent who shall cause the same to be forwarded for examination by the Provincial Auditor in manner described by the Provincial Audit Act 1866 and the Provincial Auditor is hereby required and empowered to examine and audit such accounts and balance sheet and such balance sheet shall be published in the Government Gazette of the Province immediately after the same shall have been so audited.


Schedule

All that parcel of land situated in the Province of Otago aforesaid containing by admeasurement 165 acres 2 roods and 30 poles and being Sections numbered 1,2,3 and 4 of Block number VI on the record map of the Campbelltown Hundred: bounded on the north by a public road 2,539 links towards the north-east by a public road 5,657 links or thereabouts towards the east by the road reserve 100 links wide running along the bank of the Waimatua Creek towards the south-west by Crown lands 1,680 links or thereabouts towards the south-west by Crown lands 6,915 links and 1,080 links. Also all that parcel of land situated in the Province of Otago aforesaid containing by admeasurement 77 acres 1 rood and 20 poles being Sections numbered 5,6 and 7 of Block number VI on the record map of Campbelltown Hundred: bounded on the north by a public road 3,353 links towards the north-east by Section number 26 of the aforesaid block 1,000 links or thereabout towards the east and south-east by the road reserve 100 links wide running along the bank of the Waimatua Creek and towards the south-west by a public road 5,446 links or thereabout. Also the parcel of land situated in the Province of Otago aforesaid containing by admeasurement 101 acres 2 roods and 20 poles being Sections 8 and 9 of Block number VI on the record map of Campbelltown Hundred: bounded towards the north-east by a railway reserve 2,340 links and 1,940 links or thereabout towards the south by a public road 300 links or thereabout towards the west by a public road 100 links wide along the bank of the Waimatua Creek and towards the north-west by Section number 26 aforesaid 2,430 links or thereabout. Also all that parcel of land situated in the Province of Otago aforesaid containing by admeasurement 102 acres and 37 poles being Sections numbered 10 and 11 of the aforesaid Block: bounded towards the north by a public road 3,838 links towards the east by a railway reserve 1,877 links and 2,310 links or thereabout towards the south and south-west by the road reserve 100 links wide along the bank of the Mokatua Creek and again towards the south-west by a public road, 1,540 links or thereabout and 1,856 links.
