  • Preamble

    [Repealed]

    The Preamble was repealed by section 2 Statutes Repeal Act 1907.

1 Short Title

  • This Ordinance may be cited and referred to as the Invercargill Athenaeum Reserve Management Ordinance 1875.

2 Land to be transferred to be vested in and held by the Invercargill Athenaeum

  • The parcel of land described in the Schedule hereto shall be transferred to and vested in and held by the Invercargill Athenaeum in trust for the purposes of the said Institution subject to the powers, provisions and conditions herein expressed and declared.

    Section 2 was amended by section 2 Statutes Repeal Act 1907 by omitting the word “said”.

4 Power to lease lands

  • It shall be lawful for the Committee of Management of the Invercargill Athenaeum Corporation by deed under their corporate seal to lease from time to time at such rent and on such conditions as they may think reasonable the whole or any part of the said parcel of land specified in the said Schedule hereto not required for the purposes of the said Institution for any term of years not exceeding 21 years at any one time.

5 Application of money

  • All money received by the Invercargill Athenaeum Corporation for the rents, issues, and profits of the said parcel of land shall after deducting therefrom all necessary expenses incurred in the management thereof be applied in and towards the purposes of the said Institution as the Committee of Management may from time to time determine.

6 Committee to keep accounts and furnish balance sheets to be audited

  • The Committee of Management shall keep accurate accounts of all sums of money received for rents, issues, and profits on account of the said parcel of land and of all costs, charges, expenses, and disbursements in connection with the management and maintenance thereof and within one week after the day of the annual meeting of the said Institution a copy of the balance sheet showing the receipts and disbursements of the Committee in duplicate shall be forwarded to the Superintendent who shall cause the same to be forwarded for examination by the Provincial Auditor in manner described by the Provincial Audit Act 1866 and the Provincial Auditor is hereby required and empowered to examine and audit such accounts and balance sheet and such balance sheet shall be published in the Government Gazette of the Province immediately after the same shall have been so audited.

Schedule

All that parcel of land situated in the Province of Otago aforesaid containing by admeasurement 1,097 acres and 32 perches more or less and being and comprising the Sections marked and numbered 1, 2, 3, 4, 5, 6, 7, 8, 9 and 10 of Block number X and Sections 1 and 2, 24, 25 and 26 of Block number XI on the Crown grant map of the Invercargill Hundred and being the whole of the land included in a certain Crown grant dated the 31st day of March 1875 recorded in volume 4 folio 289 in the books of the District Land Registrar, Southland District.
