An Act to make provision for the Appointment of Governors of Nelson College.

  • Preamble

    WHEREAS an Act was passed by the General Assembly of New Zealand to incorporate the Governors of Nelson College intituled The Nelson College Act 1858 and by the said Act provision is made for the election of Governors of the said College And whereas since the passing of the said Act the Province of Nelson has been divided and part thereof constituted into the Province of Marlborough And whereas it is expedient that other provisions should be made for the appointment of the Governors of the said College

BE IT THEREFORE ENACTED by the General Assembly of New Zealand in Parliament assembled and by the authority of the same as follows

1 Short Title
  • The Short Title of this Act shall be The Nelson College Act 1870.

2 Certain Governors to represent Provinces of Nelson and Marlborough
  • Six of the Governors of the said College shall be deemed to represent the Province of Nelson and shall be from time to time appointed as vacancies shall occur by the Visitor and the remaining three Governors shall be deemed to represent the Province of Marlborough and shall be appointed in like manner.

3 Council of Governors to decide which Province present Governors to represent
  • The Council of Governors shall as soon as conveniently may be after the passing of this Act decide which of the present Governors shall be deemed to represent the said Provinces respectively so that the term of office of one of the Governors representing the Province of Marlborough and two of those representing the Province of Nelson shall expire every third year.

4 Retiring Governor may hold office until successor appointed
  • Any retiring Governor may continue to hold office until his successor is appointed and may be reappointed.
