Otago University Site Exchange Act 1875

An Act to exchange a part of the Cemetery Reserve, Dunedin, for a Reserve called The Botanical Gardens, situate in the City of Dunedin, to be used as a Site for the University of Otago.

  • Preamble

    WHEREAS the parcel of land described in Schedule 1 hereto, being part of the Cemetery Reserve, Dunedin, is vested in the Superintendent of the Province of Otago: And whereas the lands described in Schedule 2 hereto are vested in the Superintendent of the Province of Otago, in trust for purposes of public recreation for the Town of Dunedin and its inhabitants: And whereas it is expedient to exchange the lands described in Schedule 1 hereto for the lands described in Schedule 2, and to change the purpose for which the lands described in the said Schedule 2 were reserved from a reserve for purposes of public recreation to a site for the University of Otago:

BE IT THEREFORE ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title

  • The Short Title of this Act shall be The Otago University Site Exchange Act 1875.

2 Lands may be exchanged

  • It shall be lawful for the Superintendent of the Province of Otago to exchange the lands described in Schedule 1 hereto for the lands described in Schedule 2, and the purpose for which the lands described in the said Schedule 2 are reserved is hereby changed from a reserve for purposes of public recreation to a site for the University of Otago.

3 Superintendent may vest management of lands in Corporation

  • The Superintendent of the Province of Otago is hereby authorized to vest the management of the lands described in Schedule 1 hereto in the Corporation of the City of Dunedin and its successors as a corporate body, in trust for purposes of public recreation for the Town of Dunedin and its inhabitants.

4 Lands may be leased

  • It shall be lawful for the Corporation of the City of Dunedin, with the sanction and consent of the Superintendent, to lease the said lands at such rents issues and profits as they may deem expedient, subject to the provisions of the Acts of the General Assembly of New Zealand, intituled The Public Reserves Act 1854, and The Public Reserves Act Amendment Act 1862, so that such leases be for any term not exceeding twenty-one years.

5 Conveyance may be made

  • The Superintendent is hereby authorized to execute and make any conveyance or other assurance for transferring to, and vesting the lands described in Schedule 2 hereto in, the Corporation of the University of Otago and its successors as a corporate body, to be held by the said Corporation and its successors as a site for the University of Otago.

Schedule 1

ALL that parcel of land in the Province of Otago, in the Colony of New Zealand, containing by admeasurement seven (7) acres two (2) roods and three (3) poles (more or less), situate in the City of Dunedin, being part of area formerly set apart for Cemetery Reserve on the map of the said city. Bounded by a line commencing at a point in Rattray Street, one hundred and sixty-two and seven-tenths (162.7) links distant from the southern corner of the said reserve; and proceeding thence in a west-north-westerly direction along Rattray Street and the Town Belt bearing 111° 38′ 42″, one thousand six hundred and ninety-two and eight-tenths (1692.8) links; thence in an east-north-easterly direction along the Town Belt bearing 66° 38′ 42″, one thousand five hundred and sixty-seven (1567) links; thence in a south-south-westerly direction bearing 25° 34′ 42″, three hundred and eighty-nine (389) links; thence in an east-south-easterly direction bearing 111° 43′ 42″, one hundred and sixty and two-tenths (160.2) links; thence in a south-south-westerly direction bearing 21° 38′ 42″, two hundred and seventy (270) links to main district road; thence in a southerly direction along the main district road, eighty-two and five-tenths (82.5) links; thence in an east-south-easterly direction bearing 111° 43′ 42″, five hundred and fifty-six (556) links to Arthur Street; thence in a south-south-westerly direction along Arthur Street, one hundred and eighty and seven-tenths (180.7) links; thence in a west-north-westerly direction bearing 111° 38′ 42″, one hundred and sixty-two and seven-tenths (162.7) links; thence in a south-south-westerly direction bearing 26° 38′ 42″, two hundred and thirty-six and five-tenths (236.5) links to the starting point; and intersected by the main district road, one hundred (100) links wide.

Schedule 2

ALL that parcel of land in the Province of Otago, in the Colony of New Zealand, containing by admeasurement seven (7) acres two (2) roods and thirty-four (34) poles (more or less), situate in the City of Dunedin, being part of area Crown granted to Superintendent, in trust, as Recreation Reserve on the map of the said town. Bounded towards the North-west by Castle Street, four hundred (400) links; by the Water of Leith, two hundred and ten (210) links; by Castle Street, one hundred and ten (110) links and two hundred and thirty (230) links; by the Water of Leith, four hundred and eighty (480) links; also by Castle Street, two hundred (200) links: towards the North-east by St David Street, sixty-seven (67) links and three hundred (300) links; towards the South-east by Leith Street, one thousand (1,000) links, four hundred and fifteen (415) links), and four hundred (400) links; and towards the South-west by Albany Street, five hundred (500) links, and intersected by Union Street, one hundred (100) links wide, also by two (2) road lines, and the Water of Leith.
