Oamaru Town Hall and Gasworks Sites and Recreation Reserves Act 1875

An Act to authorize the vesting in the Municipal Corporation of the Incorporated Town of Oamaru certain Parcels of Land, and for other Purposes.

  • Preamble

    WHEREAS it is expedient to deal with the lands particularly described in the Schedules hereto in manner hereinafter appearing:

BE IT THEREFORE ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title
  • The Short Title of this Act shall be The Oamaru Town Hall and Gasworks Sites and Recreation Reserves Act 1875.

2 Governor may grant lands in Schedules A to E to Corporation of Oamaru
  • It shall be lawful for the Governor to cause grants from the Crown of the several parcels of land described in Schedules A, B, C, D, and E of this Act to be issued to the Municipal Corporation of the Town of Oamaru, to be held by the said Corporation in trust for the purposes following, that is to say,—

    All that parcel of land described in Schedule A, as and for a site for a town hall;

    All that parcel of land described in Schedule B, for purposes of public recreation;

    All that parcel of land described in Schedule C, for purposes of public utility for the Town of Oamaru and the inhabitants thereof;

    All those two parcels of land respectively described in Schedule D, for purposes of public recreation;

    All that parcel of land described in Schedule E, for a road and right of way to Drill Shed Reserve, School Reserve, and Recreation Reserve.

3 Corporation may lease lands in Schedule C But lands in Schedules A, B, D, and E may not be leased, etc
  • It shall be lawful for the said Corporation from time to time to demise the lands specified in Schedule C, or any part or parts thereof, at such annual rent or rents and for such term of years, not exceeding twenty-one years, as the said Corporation may think fit, and the rents issues and profits thereof shall form part of the ordinary municipal revenue of the said Town of Oamaru.

    But it shall not be lawful for the said Corporation to demise or lease, or apply to any other purpose than the purpose in each case particularly expressed, any of or any part of the lands described in Schedules A, B, D, and E respectively.

4 Corporation may use lands in Schedule F as a site for gasworks
  • It shall be lawful for the said Corporation to apply and use for the purpose of erecting gasworks thereon, for the supply of the said Town of Oamaru with gas, all that piece or parcel of land described in the Schedule F of this Act.


Schedule A
Site for a town hall.

ALL that parcel of land in the Province of Otago, in the Colony of New Zealand, containing by admeasurement three (3) roods and nine (9) poles, more or less, situate in the Town of Oamaru, being part of Section numbered eight (8), Block ninety-five (XCV), on the map of the said town; bounded towards the North-west by Section numbered four (4), one hundred and twenty-eight (128) links; towards the North-east by Railway Reserve, five hundred and seventy-one (571) links; towards the South-east by Thames Street, one hundred and fifty-two (152) links; and towards the South-west by Itchen Street, six hundred and seven (607) links; be the said linkages more or less.

Schedule B
For purposes of public recreation.

ALL that parcel of land in the Province of Otago, in the Colony of New Zealand, containing by admeasurement two (2) acres, more or less, situate in the Town of Oamaru, being part of Section numbered eight (8), Block ninety-five (XCV), on the map of the said town; bounded towards the North by the New Cut for the Oamaru Creek, eight hundred (800) links; on the West by Severn Street, two hundred and twenty-five (225) links; on the South by the Railway Reserve, nine hundred and twenty-five (925) links; and on the East by Section one (1), Block ninety-five (XCV), and by Crown land three hundred and twenty-five (325) links: be the said linkages more or less.

Schedule C
Reserve for purposes of public utility.

ALL that parcel of land in the Province of Otago, in the Colony of New Zealand, containing by admeasurement one (1) acre and eighteen (18) poles, more or less, situate in the Town of Oamaru and being part of Section Nos 7 and 8 of Block XCV, bounded on the South by a line commencing at a point on the western side of Thames Street sixty-five (65) links north of the north-eastern corner of Section five (5), Block ninety-five (XCV); thence Westerly at a right angle to Thames Street two hundred and fifty (250) links; on the West by a line running parallel to Thames Street, northerly, four hundred and forty-five (445) links on the North by a line thence at right angles, easterly, to Thames Street, two hundred and fifty (250) links; and on the East by Thames Street, four hundred and forty-five (445) links; be the said linkages more or less.

Schedule D
Reserves for public recreation.

ALL that parcel of land in the Province of Otago, in the Colony of New Zealand, containing by admeasurement four (4) acres one (1) rood and thirty-four (34) poles, more or less, situate in the Town of Oamaru, being part of Sections eight (8) and seven (7), Block ninety-five (XCV), and marked Reserve for Recreation and Public Purposes on the map of the said town; bounded towards the North-west by Severn Street, five hundred and thirty-two (532) links; towards the North-east by School Reserve, being part of Section seven (7), five hundred and forty (540) links, and thence by a line to the north-western corner of the land described in Schedule C, two hundred and forty-five (245) links; on the East by the western boundary of the land described in Schedule C, southwards, four hundred and forty-five (445) links, thence westerly by a line to the point of intersection of the northern bank of the New Cut with the Oamaru Creek, one hundred and eighty (180) links, thence by the said bank one thousand (1000) links to the starting point; be the said linkages more or less.

Also, all that parcel of land in the Province of Otago, in the Colony of New Zealand, containing by admeasurement two (2) acres one (1) rood and thirty-three (33) poles, more or less, situate in the Town of Oamaru, being part of Section eight (8), Block ninety-five (XCV); bounded on the South by Itchen Street, one thousand one hundred and sixty (1160) links; on the West by Severn Street, three hundred and sixty-four (364) links; on the North and North-east by Railway Reserve, one thousand and six (1006) links; and on the East by Section numbered one (1), ninety-five (95) links; be the said linkages more or less.

Schedule E
Reserve for road and right of way.

ALL that parcel of land in the Province of Otago, in the Colony of New Zealand, containing by admeasurement one (1) rood and thirteen and a quarter (13 1/4) poles, more or less, situate in the Town of Oamaru, being part of Section numbered seven (7), Block ninety-five (XCV); bounded on the North by Section six (6), being the Mechanics Institute Reserve, two hundred and fifty (250) links, and by other part of Section seven (7), being the Drill Shed Reserve, two hundred and thirty-one (231) links; on the East by Thames Street, sixty-eight (68) links; on the South by a line parallel to the first-mentioned boundary to the south-eastern corner of other part of Section seven (7), being the School Reserve, four hundred and ninety-five (495) links; and on the West by the said School Reserve, seventy-one (71) links; be the said linkages more or less.

Schedule F
Site for gasworks.

ALL that piece of land in the Province of Otago, in the Colony of New Zealand, containing by admeasurement two acres, more or less, situate in the Town of Oamaru, commencing at a point distant one hundred and seventy (170) links east from the junction of the north-west corner of Harbour Board land and Humber Street, thence partly along the northern boundary of the Oamaru Harbour Board land three hundred and twenty-seven (327) links, thence in a northerly direction along the sea beach six hundred (600) links, thence in a westerly direction by Wear Street three hundred and fifty (350) links, thence in a southerly direction, by the Oamaru and Waitaki Railway one hundred and twenty (120) links and four hundred and seventy-nine (479) links, to the commencing point; which parcel of land is bounded towards the North by Wear Street; towards the East by the sea beach; towards the South by the Oamaru Harbour Board land; and towards the West by the said Oamaru and Waitaki Railway line.
