Auckland Harbour Foreshore Grant Act 1875

An Act to authorize the Governor to grant to the Auckland Harbour Board certain lands, being parts of the soil of the Harbour of Auckland.

  • Preamble

    WHEREAS it is expedient that the lands described in the Schedule hereto, being parts of the soil of the Harbour of Auckland, should be granted to the Auckland Harbour Board:

BE IT THEREFORE ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title
  • The Short Title of this Act shall be The Auckland Harbour Foreshore Grant Act, 1875.

2 Meaning of word plan
  • In the construction of this Act the word plan means the plan authenticated for the purposes of this Act by the signatures of the Speakers of the Legislative Council and House of Representatives respectively, and deposited in the office of the Minister for Public Works, at Wellington.

3 Governor may grant certain of the foreshore of Auckland Harbour to the Auckland Harbour Board
  • The Governor, with the advice and consent of the Executive Council of New Zealand, may, in the name and on behalf of Her Majesty, grant to the Auckland Harbour Board the several lots or parcels of land marked respectively one two and three on the plan, and thereon coloured respectively red pink and blue, and the boundaries whereof are more fully described in Schedules 1, 2, and 3 hereto respectively, but such grant shall not prejudice the rights of any persons claiming water frontage.

4 No works to be commenced on such lands except subject to certain conditions
  • It shall not be lawful for the Auckland Harbour Board, or any other person, or any body corporate, to construct or carry out any reclamation works, harbour works, or other works whatsoever on the land hereby authorized to be granted, or to erect any quay wharf jetty or other building thereon, except subject to the following conditions:—

    • (1) That the plans and specifications of such works or buildings be first submitted to and approved by the Governor in Council.

    • (2) All persons being owners of or having any lesser estate or interest in any lands which may be deprived of water frontage, or be injuriously affected by the construction of the works or buildings, shall be entitled to receive compensation for such deprivation of water frontage or injury, the amount whereof shall be ascertained in the manner set forth in The Lands Clauses Consolidation Act; 1863, and The Lands Clauses Consolidation Act Amendment Act 1866.


Schedule 1

ALL that area bounded on the North by a line from the centre of the Sentinel Rock, or Watchman, towards the centre of the Bastion Rock; on the East by a line running due south on true meridian from the aforesaid line to the north-eastern point of Lot No 15 of Section No 8 of the Suburbs of Auckland; on the South by Lots Nos 15 and 14 of section aforesaid, by the abutment of a road one hundred (100) links wide, by Lots Nos 11 and 12 of section aforesaid, by the abutment of a road one hundred (100) links wide, by Lots Nos 7, 8, 9, and 10 of section aforesaid, by the abutment of a road one hundred (100) links wide, and by Lots Nos 5 and 3 of section aforesaid; and on the West by a line due south on true meridian from the centre of the Sentinel Rock, or Watchman, aforesaid to the seaward boundary of Lot No 3 aforesaid.

ALL that area bounded on the North by a line, being the continuation of the line from the Sentinel Rock, or Watchman, to the centre of the western boundary of the Bastion Rock; on the East by a line running due south on true meridian to the northern or seaward boundary of Oraki Block No 1338, in the Parish of Waitemata, by the seaward boundary of Block No 1338 aforesaid to the Purewa Creek, by Lots Nos 39A, 33, and 38A of Parish of Waitemata aforesaid, and by the water-line boundary of Lot No 220 of Section No 16 of the suburbs of Auckland, and by Lot No 38A aforesaid; on the South by Lot No 179 of Section No 16 aforesaid, by the abutment of a road one hundred (100) links wide, by Lots Nos 175 and 176 of Section No 16 aforesaid, by the abutment of a road one hundred (100) links wide, by Lots Nos 178, 177, 172, and 163 of Section No 16 aforesaid, by a Maori Reserve, by Lots Nos 161 and 162 of Section No 16 aforesaid, by a reserved piece of land round the western side of the Oraki Basin, by a landing reserve, by Lots No 194, 195, 196, 197, 198, 199, 200, 201, 202, 203, 204, 205, 206, 207, 208, 209, and 212 of Section No 16 aforesaid, by a road one hundred (100) links wide, by Lots Nos 91, 92, and 93 of Section No 16 aforesaid, by the abutment of a road one hundred (100) links wide, by Lots Nos 63, 62, and 61 of Section No 16 aforesaid, by the abutment of a road one hundred (100) links wide, by Lots Nos 59, 57, 55, 53, and 51 of Section No 16 aforesaid, by Lots Nos 5 and 3 of Section No 16 aforesaid, by the abutment of a road one hundred (100) links wide, by Lot No 1 of Section No 16 aforesaid, and by a landing reserve, by a continuation of the water-line, and by the abutment of a road one hundred (100) links wide; and on the West by Lots Nos 7 and 3 of Section No 4 of the Suburbs of Auckland, by the abutment of a road one hundred (100) links wide, by Lots Nos 22 and 20 of Section No 2 of the Suburbs of Auckland, by the abutment of a road one hundred (100) links wide, by Lots Nos 17, 15, and 23 of Section No 2 aforesaid to the northern extremity of Point Resolution, and by a line from the said northern extremity of Point Resolution running due north on true meridian till it intersects the line running from the Sentinel to the Bastion aforesaid.

  • The reference to Maori was substituted, as from 27 November 1947, for a reference to Native pursuant to section 2(2) Maori Purposes Act 1947 (1947 No 59).
