Invercargill Public Offices Site Act 1875

An Act to vest in Her Majesty the Queen the Provincial Government Building Reserve situate in Invercargill, and to authorize the Invercargill Athenaeum to exchange a piece of Land held by it for a piece of Land intended by this Act to be vested in Her Majesty.

  • Preamble

    WHEREAS under The Public Reserves Act 1854, the piece of land described in Schedule 1 hereto was, amongst others, on or about the twenty-eighth day of October, one thousand eight hundred and sixty-four, granted by the then Governor of the Colony of New Zealand to the Superintendent of the Province of Southland and his successors as sites for Provincial Government buildings: And whereas under the powers contained in The Invercargill Athenaeum Reserve Management Ordinance 1871, the piece of land described in Schedule 2 hereto was transferred to and vested in the Invercargill Athenaeum: And whereas it is desired to vest the piece of land described in Schedule 1 hereto, except such portion as is described in Schedule 2 hereto, in the General Government of the Colony as the site for public offices: And also to exchange the piece of land described in Schedule 3 hereto, being part of the lands vested as aforesaid in the Invercargill Athenaeum, for the piece of land described in Schedule 4 hereto.

BE IT THEREFORE ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title

  • The Short Title of this Act shall be The Invercargill Public Offices Site Act 1875.

2 Land in Schedule 1 to be vested in Her Majesty

  • Notwithstanding the piece of land described in Schedule 1 hereto has been so granted as aforesaid, the said piece of land, with the exception of the piece of land described in Schedule 2 hereto, shall without any conveyance vest in and be held by Her Majesty as a public reserve for public offices, or for the purpose of other public buildings for the use of the General Government of the Colony.

3 Power to Invercargill Athenaeum to exchange land in Schedule 3 for land in Schedule 4

  • It shall be lawful for the Invercargill Athenaeum to convey or transfer the piece of land described in Schedule 3 hereto to Her Majesty in exchange for the piece of land described in Schedule 4 hereto.

4 Purposes for which lands in Schedules 3 and 4 to be held

  • The piece of land described in Schedule 3 hereto shall be held by Her Majesty for the same purposes as are declared in the second section of this Act with respect to the land described in Schedule 1 hereto, with the exception of the land described in Schedule 2 hereto: and the piece of land described in Schedule 4 shall be held by the Invercargill Athenaeum upon the same trusts and for the same purposes as the piece of land described in Schedule 3 was, prior to such conveyance or transfer, held by it.

5 Athenaeum not to make any building etc on blocks specified

  • It shall not be lawful for the Invercargill Athenaeum to make any building or erection on the block of land situate on the east side, of the piece of land described in Schedule 3 hereto, and having a frontage of twenty feet on Esk Street, and a depth of sixty-seven feet; nor to make any building or erection on the block of land situate on the west side of the land described in Schedule 4 hereto and being part thereof, having a frontage of twenty-one feet on the Crescent, and a depth of fifty-two feet on the west end, and a depth of fifty-eight feet on the east end of the said block; but each of the said two blocks of land shall be used by the Invercargill Athenaeum as a yard or passage only.

6 Athenaeum not to make any building on land in Schedule 4, except in accordance with approved designs

  • It shall not be lawful for the Invercargill Athenaeum to make any building or erection on the piece of land described in Schedule 4 hereto, except in accordance with designs previously submitted to and approved in writing by the Minister for Public Works for the time being.

Schedule 1

ALL that piece or parcel of land bounded on the North by Esk Street, 330 feet or thereabouts; on the East by Dee Street, 330 feet or thereabouts; and on the West and South-west by the Crescent, running from Dee Street to Esk Street, 520 feet or thereabouts.

Schedule 2

ALL that piece or parcel of land bounded on the North by Esk Street, 165 feet or thereabouts; on the South by portion of the Government Reserve, 165 feet or thereabouts; on the East by Dee Street, 67 feet or thereabouts; and on the West by portion of the said Reserve, 67 feet.

Schedule 3

ALL that piece or parcel of land bounded on the North by Esk Street, 77 feet 6 inches or thereabouts; on the South by portion of the Government Reserve, 77 feet 6 inches or thereabouts; on the East by a portion of the Athenaeum Reserve, 67 feet or thereabouts; and on the West by portion of the Government Reserve, 67 feet or thereabouts.

Schedule 4

ALL that piece or parcel of land bounded on the North by a portion of the Government Reserve, 87 feet 6 inches or thereabouts; on the South by the Crescent, 92 feet or thereabouts; on the East by Dee Street, 67 feet or thereabouts; and on the West by portion of the said Reserve, 52 feet or thereabouts.
