Lawrence Athenaeum and Mining Institute Reserve Act 1876

AN ACT to vest a certain Reserve in the Lawrence Athenaeum and Mining Institute, and to provide for Leasing the said Reserve.

  • Preamble

    WHEREAS by a grant from the Crown dated the second day of November, one thousand eight hundred and seventy-five, the land described in the Schedule to this Act was granted to James Macandrew, as and being Superintendent of the Province of Otago, in trust for the Lawrence Athenaeum and Mining Institute: And whereas by an Ordinance, No 368, intituled the “Lawrence Athenaeum and Mining Institute Reserves Management Ordinance, 1872,” passed by the Superintendent and Provincial Council of Otago, certain other lands conveyed to the said Lawrence Athenaeum and Mining Institute were authorized to be leased and managed as in the said Ordinance appears: And whereas it is expedient and desirable the said land mentioned and described in the Schedule to this Act should be conveyed to the said Lawrence Athenaeum and Mining Institute, and leased and managed as the said Ordinance, to wit the “Lawrence Athenaeum and Mining Institute Reserves Management Ordinance, 1872,” provides:

BE IT THEREFORE ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title

  • The Short Title of this Act shall be The Lawrence Athenaeum and Mining Institute Reserve Act 1876.

2 Land vested in Lawrence Athenaeum and Mining Institute

  • The land described in the Schedule to this Act shall be and is hereby absolutely vested in the Lawrence Athenaeum and Mining Institute, incorporated by an Ordinance of the Superintendent and Provincial Council of Otago, No 367, and intituled the “Lawrence Athenaeum and Mining Institute Ordinance, 1872”; and James Macandrew, Esquire, as and being Superintendent of the Province of Otago, shall transfer the said parcel of land to the said Lawrence Athenaeum and Mining Institute.

3 Certificate of title may issue

  • The District Land Registrar of Otago may grant a certificate of title to the said land described in the Schedule to the said Lawrence Athenaeum and Mining Institute should the said James Macandrew, as and being such Superintendent, not execute such a transfer within six months after the passing of this Act.

4 Institute may lease land

  • The said Lawrence Athenaeum and Mining Institute may from time to time lease the said land described in the Schedule, by deed or memorandum of lease under its corporate seal, for any term or terms of years not exceeding twenty-one years at any one time, and subject to such terms and conditions as the said Lawrence Athenaeum and Mining Institute shall determine.

5 How moneys arising from lease to be applied

  • All moneys rents issues and profits arising from the lease of the said land shall be applied in the same manner as the said “Lawrence Athenaeum and Mining Institute Reserves Management Ordinance, 1872”, provides for moneys issues and profits received under the said Ordinance, and be subject to the provisions of the said Ordinance.

Schedule

ALL that parcel of land in the Province of Otago, in the Colony of New Zealand, situate in the Beaumont District, being Sections numbered respectively 1, 2, 6, 7, 11, and 23, Block I, on the map of the said district, containing by admeasurement 504 acres 2 roods 5 perches, more or less. Bounded towards the North by Section number 5, 2880 links, also by Section number 3, 3370 links; towards the East by Block II, 4678 links and 2982 links; towards the South by Section number 10, Block I, 4755 links; towards the North-west by a road line, 1654 links; again towards the South by Section number 8, Block I, 4951 links; again towards the North-west by a road line, 3584 links; and towards the West by Section number 22, Block I, 4105 links; and intersected by three road lines each 100 links wide; also by railway reserve.
