Wellington Hospital and College Reserves Exchange Act 1876

An Act to enable the Trustees of the Wellington Hospital and the Governors of the Wellington College to exchange certain Lands.

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:

1 Short Title
  • The Short Title of this Act shall be The Wellington Hospital and College Reserves Exchange Act 1876.

2 Trustees of Wellington Hospital may exchange land in Schedule 1 with Governors of Wellington College

    Sections 2 and 3 were repealed, as from 19 November 1907, by section 2 Statutes Repeal Act 1907 (1907 No 40).

3 Governors of Wellington College may exchange land in Schedule 2 with Hospital Trustees

    Sections 2 and 3 were repealed, as from 19 November 1907, by section 2 Statutes Repeal Act 1907 (1907 No 40).

4 Trustees and Governors may not sell lands nor lease lands except under certain conditions
  • The Governors of the Wellington College, shall from and after the passing of this Act have no power to sell any of the lands belonging to the said College, and shall have no power to lease the same for a longer period than forty-two years; and every such lease shall be made without taking premium or foregift, and without power of renewal; but nothing in this Act contained shall be taken to invalidate any contract made prior to the twenty-first day of October, one thousand eight hundred and seventy-six.

    Section 4 was amended, as from 19 November 1907, by section 2 Statutes Repeal Act 1907 (1907 No 40) by omitting the words The Trustees for the time being of the Wellington Hospital Reserves, or, Hospital and and respectively.

Hospital to college.

Schedules

All that parcel of land containing by admeasurement 20 perches, being part of the Section numbered 605 on the plan of the City of Wellington, in the Province of Wellington. Bounded towards the South-east by Fitzherbert Terrace, 210 links, a little more or less; towards the West by that portion of Molesworth Street lying between Fitzherbert Terrace and the angle in Molesworth Street between Fitzherbert Terrace and the Tinakori Road; and towards the North by a straight line from the said angle in Molesworth Street to a point on Fitzherbert Terrace distant 230 links, a little more or less, from Molesworth Street.

Schedule 2
College to hospital.

ALL that parcel of land containing by admeasurement 34 perches, being parts of the Sections numbered 592 and 603 on the plan of the City of Wellington, in the Province of Wellington. Bounded towards the North-west by Fitzherbert Terrace; towards the North-east by a line at right angles to Fitzherbert Terrace, and commencing at a point on Fitzherbert Terrace 357 links distant from Hobson Street; and towards the Southwest by the top of the south-western bank of the dry gully there.
