Dunedin Wharves and Quays Reserves Act 1876

An Act to vest the Dunedin Wharves and Quays Reserves in a Body Corporate.

  • Preamble

    WHEREAS the reserves described in the Schedule to this Act have been granted to the Superintendent of the Province of Otago in trust for wharves and quays in the City of Dunedin: And whereas by The Dunedin Reserves Management Ordinance 1867, the management of the said lands was vested in the Corporation of the City of Dunedin, to be held by the said Corporation and its successors in trust for the like purposes for which such lands are now held, which purposes are severally named and set forth in the fourth paragraph of the Schedule 1 to the said Ordinance, and designated as a reserve for public wharves and quays: And whereas it is desirable that the said reserves should be vested in the Otago Harbour Board:

BE IT THEREFORE ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:

1 Short Title
  • The Short Title of this Act shall be The Dunedin Wharves and Quays Reserves Act 1876.

2 Lands vested in Otago Harbour Board
  • The lands described in the Schedule to this Act shall be and the same are hereby vested in the Otago Harbour Board in trust for the purposes for which the said lands were granted to the Superintendent of Otago, and for other like purposes, except and reserved therefrom such portion of the said land as is now used and forms part of the Dunedin and Port Chalmers Railway, which portion is hereby absolutely vested in Her Majesty, her heirs and successors.

3 Lands to be leased
  • The said lands shall be leased and managed by the Otago Harbour Board in accordance with the provisions and powers in any Act relating to the other reserves of the said Otago Harbour Board, in trust for the erection of wharves and quays and the improvement of the Otago Harbour.

4 Mortgages transferable
  • Notwithstanding the provisions of The Otago Harbour Ordinance 1874, the Board may, by an indorsement on the mortgages authorized to be issued under the said Ordinance, make the said mortgages transferable by delivery and without the assignment by deed in the said Ordinance mentioned.


Schedule

ALL that parcel of land in the Province of Otago, in the Colony of New Zealand, situate in the town of Dunedin, containing by admeasurement eighteen acres two roods and four poles (18a 2r 4p), more or less, on the map of the said town. Bounded towards the North-west by Castle Street one hundred and seventy-two (172) links, by Athol Place three hundred and twenty-eight (328) links and two thousand seven hundred and twenty (2720) links, by Forth Street six hundred and twenty-four (624) links and two hundred and sixteen (216) links, by the Water of Leith one thousand one hundred and fifty (1150) links and five hundred and fifty (550) links, also by a street line five hundred and twenty-two (522) links; towards the North-east by the Water of Leith two hundred and eighty (280) links, by Albany Street one thousand one hundred and thirty-five (1135) links, also by St Andrew's Street five hundred (500) links; towards the South-east by Otago Harbour three hundred and eighty (380) links, one thousand three hundred and twenty (1320) links, eight hundred and fifty (850) links, five thousand eight hundred and fifty (5850) links, and four hundred and twelve (412) links, and by Leith Street twenty-six (26) links; and towards the South-west by Otago Harbour five hundred and ninety (590) links, by Albany Street four hundred and sixty-eight (468) links, also by the Water of Leith eight hundred and ninety-five (895) links, and three hundred and forty-five (345) links. As a site for public wharves, save and except such part of the said area as may have been set apart by any Act of the Assembly for educational purposes.
