Queenstown Commonage Reserve Management Act 1876

An Act to provide for the Management of certain Reserves in the Province of Otago and adjacent to the Incorporated Town of Queenstown.

  • Preamble

    WHEREAS by grants from the Crown the lands described in the Schedule to this Act are vested in the Superintendent of the Province of Otago in trust as a reserve for the purpose of a common for the use of the inhabitants of the Town of Queenstown: And whereas it is expedient and desirable that due provision should be made for the management of the said lands:

BE IT THEREFORE ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title
  • The Short Title of this Act shall be The Queenstown Commonage Reserve Management Act 1876.

2 Lands vested in Corporation of Queenstown
  • The said lands described in the said Schedule shall be and they are hereby transferred to and vested in the Corporation of the Incorporated Town of Queenstown, incorporated under and by virtue of The Otago Municipal Corporations Ordinance 1865 (hereinafter called the said Corporation).

3 Licenses may be issued, and lands managed
  • It shall be lawful for the said Corporation to manage the said lands in such a manner as the said Corporation thinks the purposes for which the said lands were granted can best be carried out, and to issue yearly licenses authorizing inhabitants of the said town to depasture cattle thereon, and the fees for such licenses to fix and determine.

4 Application of moneys
  • All moneys received by the said Corporation for the rents issues license fees or profits of the said lands shall be used and employed for improving the said lands, and for beautifying and improving any recreation reserves vested in the said Corporation.

5 Accounts to be kept
  • The said Corporation shall keep a separate account of all the moneys received from the said rents issues license fees and profits of the said lands, and such account shall be audited by the Auditors of the Corporation once in every year, and a copy of such account shall be published in the New Zealand Gazette, and in one newspaper circulating in the district.


Schedule

ALL that parcel of land in the Province of Otago, in the Colony of New Zealand, situate in the Shotover District, being portion of area marked Commonage Reserve Block, numbered twenty (XX) on the map of the said district, containing by admeasurement two hundred and sixty-two (262) acres three (3) roods and twenty-three (23) poles, more or less. Bounded towards the North-east by Crown lands, eight thousand one hundred and twenty (8120) links; towards the East by section numbered 20, one thousand four hundred and thirty-one (1431) links; towards the South-east by section numbered 32, eight hundred and sixty (860) links; towards the South by section numbered 20, one thousand five hundred (1500) links, also by sections numbered respectively 32, 33, and 35, one thousand four hundred and fifty-seven (1457) links; towards the South-west by the Town of Queenstown, four thousand nine hundred and twenty (4920) links; and towards the West and North-west by sections numbered respectively 9 and 11, four thousand eight hundred and fifty-six (4856) links. As a reserve for the purpose of a common for the use of the inhabitants of the town of Queenstown.

All that parcel of land in the Province of Otago, in the Colony of New Zealand, situate in the Shotover and Mid-Wakatipu Districts, containing by admeasurement three hundred and thirty-seven (337) acres and seventeen (17) poles, more or less, being part of Block numbered twenty (XX), together with a part of Mid-Wakatipu District. Bounded towards the North-west by Crown lands, twelve thousand eight hundred and twenty (12820) links, also by section numbered 2 of the said Block XX three hundred (300) links; towards the North-east by the Town of Queenstown, one thousand two hundred (1200) links; towards the South-east by sections numbered respectively 10, 12, 22 and 23, five thousand three hundred and sixty-eight (5368) links, by Cemetery Reserve one thousand six hundred and forty-eight (1648) links, by the Township of Queenstown and section numbered 3 of the said Block XX, three thousand one hundred and thirty (3130) links, by Lake Wakatipu four thousand four hundred (4400) links; also by the said section numbered 2, Block XX, and section numbered 1, Mid-Wakatipu District, six hundred (600) links; and towards the South-west by Crown lands four hundred and twenty (420) links and three thousand and fifty (3050) links, also by section numbered 2 of the said Block XX one thousand and seventy (1070) links, exclusive of sections numbered 1 and 4 of the said Block XX. As a reserve for the purpose of a common for the use of the inhabitants of the Town of Queenstown.
