Poverty Bay Land and Deeds Registration Districts Act 1896

An Act to constitute a Land and Deeds Registration District for Poverty Bay.

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:

1 Short Title

  • The Short Title of this Act is The Poverty Bay Land and Deeds Registration Districts Act 1896.

2 Interpretation

  • In this Act, if not inconsistent with the context,—

    Register-office means and includes Land and Deeds Register Office

    Registrar includes Registrar of Deeds and District Land Registrar

    Register means and includes all registers, record-books, indices, and books of reference required to be kept under the provisions of The Land Transfer Act 1952, and of The Deeds Registration Act 1868, or of any regulation under the said Acts respectively.

    The Land Transfer Act 1885 (1885 No 57) was consolidated, as from 4 August 1908, by section 1(2) Land Transfer Act 1908 (1908 No 99). That Act was in turn repealed, as from 1 October 1915, by section 2 Land Transfer Acts Compilation Act 1915 (1915 No 35). Appendix B of the repealing Act replaced the 1908 Act with a compiled Act enacted under the title of “The Land Transfer Act 1915”. That Act was in turn repealed, as from 1 January 1953, by section 245(1) Land Transfer Act 1952 (1952 No 52).

3 Land in Schedule constituted a new land and deeds registration district

  • On and after the first day of January, one thousand eight hundred and ninety-seven, the district the boundaries whereof are defined in the Schedule hereto (hereinafter called the said district) shall cease to be within the limits of the Hawke's Bay and Auckland Land and Deeds Registration Districts, and shall be a separate land registration district within the meaning of The Land Transfer Act 1952, and shall also be a separate deeds registration district within the meaning of The Deeds Registration Act 1868, under the name of “The Poverty Bay Land and Deeds Registration District”.

    The Land Transfer Act 1885 (1885 No 57) was consolidated, as from 4 August 1908, by section 1(2) Land Transfer Act 1908 (1908 No 99). That Act was in turn repealed, as from 1 October 1915, by section 2 Land Transfer Acts Compilation Act 1915 (1915 No 35). 4 Governor may appoint register-office for new district

  • There shall be within the said district, at such place as the Governor shall from time to time appoint, a register-office for the purposes of this Act, and, upon the appointment of a Registrar for the said district, all records relating exclusively to land within the said district shall be transferred to the custody of such Registrar, and shall be deposited in the office aforesaid.

5 Portion of existing Hawke's Bay Land and Deeds Registration District to be included in Auckland District

  • So much of the present Hawke's Bay Land and Deeds Registration District north of the thirty-ninth parallel of latitude as is not included in the district hereby created shall, on and after the first day of January, one thousand eight hundred and ninety-seven, cease to be within the Hawke's Bay Land and Deeds Registration District, and shall be included in and form part of the Auckland Land and Deeds Registration District.

6 Copies of existing registers made available for new district

  • (1) Copies shall be made of such or so much of the registers in the register-offices at Napier and Auckland respectively as are necessary for the purposes of this Act in respect of the district hereby created, and shall be deposited in the register-office for the said district.

    (2) The like copies shall be made of such or so much of the registers in the register-office at Napier as are necessary for the purposes of this Act in respect of that portion of the present Hawke's Bay Land and Deeds Registration District which is hereby included in the Auckland District, and shall be deposited in the register-office for the Auckland District.

    (3) All such copies shall, when so deposited, have the force and effect of the original registers, and shall for all purposes of this Act be deemed to be the original registers, and be admissible in evidence for all purposes for which such original registers would be admissible.

Schedule

ALL that area in the Colony of New Zealand, bounded towards the north generally by the sea from the eastern boundary of Whangaparaoa No 2 Block to East Cape; thence towards the south-east generally by the sea to the northern boundary-line of Takararoa Block (Ngakau-o-te-Paritu); thence towards the south generally by Takararoa and Paritu No 2 Blocks, by the summit of the range between the Waiau and Tunanui Rivers, being the western boundary-line of Paritu Block, by Section No 1, Block XI, Nuhaka North Survey District, and the south-western boundary-lines of Okahu, Maraetaha No 2C and Maraetaha No 2 Blocks to Pukehou Trig Station; thence by the south-eastern boundary-lines of Haerengarenga Block, by Nuhaka No 2 Block, Tukemokihi No 1 and Kahuitara No 1A Blocks, to the Maromauku Stream; thence by that stream, the Kauhouroa Stream, the Wairoa and Waiau Rivers, and the Tutaekuri Stream, by Sections Nos 2 and 1, Block XIX, Taramarama Survey District, Section No 1, Block XVIII, Section No 1, Block III, Waihua Survey District, and Section No 1, Block II, and by Mohaka Nos 2 and 1 Blocks to the Mohaka River; thence by that river to its confluence with the Te Hoe River; thence towards the west by Te Hoe River to the south-eastern boundary-line of the Heruiwi No 4 Block, towards the north-west generally by that block to the Waiau River; thence by the left bank of said Waiau River to the north-western boundary-line of Section No 1, Block VIII, Mangahopai Survey District; thence by that boundary-line and the north-western boundary-line of Block V, Waiau Survey District (Education Reserve), and by the production of the last-mentioned line to Waikaremoana; thence by the western and northern shores of that lake to the Waipaoa Block; thence by the western boundary of that block and the western boundary of Tahora No 2 Block to a point in line with the south-eastern boundary-line of Oamaru No 1 Block; thence by a right line to and by said block, and by Oamaru Nos 2, 5, 6, and 7 Blocks, by Whitikau Nos 3A and 2, to the south-eastern corner of the last-mentioned block; thence by a right line running due east to the Motu River; thence by that river to a right line drawn from Purahotakaha Trig Station to Puketoetoe Trig Station; thence by part of the said line to the said Purahotakaha Trig Station; thence by the summit of the leading range to Whanakao Trig Station; and thence by Kumi No 1, Waikura, and Whangaparaoa No 2 Blocks to the sea.
